There are two large windows street side that are perfect for vinyl signage to advertise your business. Two rooms with high ceilings and natural wood trim provide a classic feel for your clients. Scenario 2: Mr. E. Ferrars, an unmarried man with no children, earns a respectable living. His mother is alive and he has two adult siblings; however, he is not on particularly good terms with any of them. Under Indiana law, his property would be split into three equal shares for them since he has no will. This does not seem likely to be what he wants.

At this particular client appointment, we would need to discuss not only beneficiaries for his property, but also powers of attorney. In his situation (meaning unmarried and without children), his mother and his adult siblings could all potentially be designated as his default health care representatives unless he appoints someone else. He has a friend and neighbor, Colonel Brandon, who might be a good option.

I would also likely discuss how to properly transfer assets to minors with Mr. Ferrars as he does have a nephew.

Scenario 1: Mr. F. Darcy, an unmarried man with no children, owns extensive property and has a very healthy financial portfolio. Both of his parents are deceased and he has only one sister. Under Indiana law, his sister inherits everything at his death, even without a will.

The catch is that his sister is just fifteen years old. He currently shares guardianship of his sister with a cousin, Colonel Fitzwilliam.

Without a will, the court in his jurisdiction will have to choose and appoint an executor for the estate and Indiana law will determine when Miss Darcy receives the property outright. Colonel Fitzwilliam is the most likely choice for executor, but Mr. Darcy, Miss Darcy, and Colonel Fitzwilliam have an overbearing aunt that it would be best to keep out of the estate.

So, Mr. Darcy needs to work with an estate planning attorney to very clearly state his wishes regarding his sister, the person to take charge of her inheritance until she is old enough to manage her own finances (an age that he will be able to direct), the person to serve as executor of the estate, and the many other directives necessary. This is a situation where a trust would be an excellent choice. He should also discuss powers of attorney for finances and health care since his sister is currently a minor and unable to act on his behalf. Indiana law even allows him to specifically direct that his aunt, a Mrs. C. de Bourgh, is not to represent him in any capacity.
