PART 8 OF 10: I‑94 Records and Replacing Lost or Unavailable Registration Evidence

An I‑94 is an arrival-and-departure record that may document a person’s admission, parole, immigration classification, and authorized period of stay. For many noncitizens, it may also serve as evidence of registration.

Most travelers with an electronic I‑94 can retrieve and print it through the official CBP I‑94 website or CBP Link. Review your:

• Legal name and date of birth
• Passport information
• Most recent entry date
• Class of admission
• “Admit Until” date

Do not assume your visa’s expiration date determines your authorized stay. The I‑94 generally contains the controlling admission information, subject to individual circumstances and later government action.

If your evidence is missing, incorrect, or unavailable, the appropriate procedure depends on the document and issuing agency:

• For a CBP-issued I‑94, begin with CBP or a deferred-inspection office.
• For a USCIS-issued I‑94, Form I‑102 procedures may apply.
• For USCIS Proof of G‑325R Registration, check the registrant’s USCIS online account.
• For a Green Card or Employment Authorization Document, follow the document-specific replacement process.

Do not file Form G‑325R merely to replace existing registration evidence. Many noncitizens are already registered. Identify the correct document and issuing agency before taking action.

Digital evidence can become important after a collision, injury, or other legal dispute—but it can also be deleted, overwritten, or misplaced.

As soon as it is safe:

• Preserve original photographs and videos without cropping, filtering, or editing them.
• Back up text messages, emails, receipts, and relevant electronic records.
• Note when and where each item was created or obtained.
• Identify dashcam, doorbell-camera, business-surveillance, or traffic-camera footage that may be erased automatically.
• Avoid discussing the incident or posting evidence publicly while the matter is unresolved.

Never access another person’s account or device without permission. An attorney can help determine what evidence may be relevant and how it should be preserved.

Does filing or receiving approval of Form I-130 give my relative lawful immigration status?

The short answer is no.

Form I-130 is generally used to establish a qualifying family relationship. USCIS states that filing or approving the petition does not, by itself, give the beneficiary immigration status or an immigration benefit.

Depending on the circumstances, the beneficiary may still need to:

🔹 Apply for adjustment of status in the United States, if eligible; or
🔹 Complete immigrant-visa processing through a U.S. consulate abroad.

Visa availability, immigration history, manner of entry, admissibility, and other factors can affect the next step. Do not assume that an approved family petition automatically authorizes someone to remain or work in the United States.

🚗 TODAY’S TIP: Preserve the Details After a Crash

Your safety comes first. Call 911 when someone is injured, a vehicle cannot be safely moved, or there is another emergency.

If it is safe to do so:

📸 Photograph the vehicles, damage, roadway, traffic controls, and surrounding conditions.
🪪 Exchange names, contact information, license-plate numbers, and insurance details.
👥 Obtain contact information from witnesses.
📝 Record the police-report or incident number.
📂 Preserve repair estimates, receipts, medical records, and insurance communications.

Clear, organized documentation can help the insurance company and your attorney understand what happened.

🚨 IMMIGRATION LAW UPDATE

On August 6, 2026, a new Executive Order titled “Ending Birth Tourism” directed the State Department and Department of Homeland Security to strengthen policies addressing the use of nonimmigrant visas for the purpose of giving birth in the United States.

Possible measures may include visa denial or revocation, permanent entry bars, denial of admission, or removal. Humanitarian and national-interest exemptions may be granted at agency discretion.

Important: The order focuses on visa use, entry, and immigration enforcement. It does not itself declare an end to birthright citizenship.

Updating your address with the U.S. Postal Service is not enough. USCIS and the Immigration Court maintain separate records:

✅ USCIS: Most noncitizens must report a new address within 10 days.
✅ Immigration Court or BIA: Report changes within five working days.
✅ Update each agency separately and keep proof of submission.

Missing an important notice could mean missing an interview, filing deadline, or court hearing. Notify your attorney immediately whenever your contact information changes.
