Happy New Year - A link is attached with information concerning this year's minimum wage. For non-tip workers the minimum wage is $12.32. I have had several people tell me it was $15.00 per hour this is not correct. The City and County of Denver set their rate at $14.77. This is not applicable to the rest of the State.

Sealing of Criminal Records:

This is good news for a bunch of people with minor felony drug offenses.

Starting on August 2nd, 2019, many people with criminal records and convictions will be able to have their records sealed. This includes most drug possession and other relatively minor offenses.

A person convicted of a crime can move the court to seal their record if they have completed their sentence, and have not re-offended, and the following time limits have elapsed.

1. One year for Petty Offenses
2. Two years for Class 2 or 3 Misdemeanors
3. Three years for eligible Class 4, 5 or 6 felonies, Class 3 or 4 Drug Felonies and Class 1 Misdemeanors
4. Five years for all other eligible offenses

The person attempting to seal the record has to pay a $65.00 filing fee, provide a current copy of their criminal history, notify the District Attorney and file the proper paperwork.

Not all crimes are eligible to be sealed. Ineligible convictions include domestic violence, impaired driving, s*x offenses, and serious felonies. For more information please contact us to see if we can help (970) 356-1990

How do I seal my record?

Is a question I answer at least once a week (usually at a bbq). You might be surprised to learn your case can be sealed with relative ease under the “simplified process”. Here are a few tips if you are interested:

1. If the case was dismissed, you are acquitted or you completed a deferred judgments, you can immediately have the records sealed.

This can be done by asking the court orally or in writing. They charge a $65.00 processing fee. See CRS § 24-72-702.5.

a. This can be done anytime, so if you have an old dismissed case in the system you can still get it sealed.

b. This applies to successfully completed deferred judgments

c. It applies to successfully completed diversion.

2. If you are actually convicted you cannot have the case sealed unless it is low level drug conviction.

3. If you have a Juvenile conviction you will have to use the formal expungement process. There is maybe a filing fee.

4. Some types of low level drug convictions can use the formal expungement process we will follow up with a post concerning this type of thing at a later date.
