We would like all of our clients, colleagues and friends to be aware that there were significant changes to the New York Medicaid laws which could be very impactful. Previously, individuals were permitted to transfer assets and become almost immediately eligible for Community-based Medicaid services (Home Care). Now, as a result of this major law change, a penalty will be imposed for assets that were previously transferred. The lookback period will be phased in, but there WILL be a penalty imposed on non-exempt transfers that took place on or after October 1, 2020 for all Medicaid Home Care applications submitted on or after April 1, 2021.

Why is this important now?

If your client or family member is in need of a home health aide or you believe he or she will be in need of care in the near future, it may be wise to apply for Medicaid prior to April 1, 2021. That date is fast approaching. Our team is ready to assist with advice regarding transfers and the Medicaid application process.
