🏡 REAL ESTATE TIP: What does it mean to enter into a Contract with "Right to Inspection with No Requests?"

This has been one of the most often misunderstood and misused parts of the Contract so I wanted to take a moment to clear the air on what the Contract actually reads.

In our area under the Contract 8.0, you have three (3) options related to inspection: Waiver (no inspection), Inspection for Major Issues (most common, broad and this will be explained in another post), and the star of this post: "Right to Inspection With No Requests." Under that type of provision, the buyer generally has only two choices after the inspection:

✅ Proceed with the purchase as-is; or

✅ Terminate the Contract if the property's condition is unacceptable.

What the buyer cannot do under that language is demand repairs, credits, or concessions from the seller. In fact, this provision specifically states that if the buyer requests repairs or credits, the seller may elect to terminate the contract and return the earnest money. A common misconception, even among attorneys, is that health and safety issues automatically create an exception to how this provision is written. They do not! Whether the concern is mold, electrical issues, plumbing defects, structural concerns, code violations, or another safety-related matter, the Contract controls. If the parties wanted an exception allowing negotiation for those items, they could have written one into the agreement.

The purpose of a "No Requests" inspection contingency is simple: it gives the buyer the opportunity to inspect the property and decide whether to move forward...not to renegotiate the deal.

As always, the most important words in a real estate transaction are the ones actually written in the Contract.
