🚨 Public Charge is changing. Here’s what you should know.
Beginning September 18, 2026, USCIS will implement new guidance following DHS’s rescission of the 2022 Public Charge regulation. The new framework gives immigration officers broader discretion to consider certain public benefits and other factors when making a public charge determination.
But here’s what’s important:
Receiving public benefits does not automatically make someone a “public charge”. The determination depends on the individual’s circumstances, immigration category, and the type of application being filed.
The new framework also comes with a revised Form I-485, which USCIS will begin requiring on September 18.
🚨There is no general pause on green card applications through USCIS due to the new public charge rule. However, some immigrant visa processing abroad has been temporarily paused as the Department of State implements the updated public charge standards. 🚨
