ESTA UPDATE: As of right now, these are still the rules. There are amendments, which we have posted about. But as of today, the amendments have not passed and the legislature has not delayed the effective date of the as-is version, meaning the law will be effective, tomorrow, as-is.

URGENT UPDATE FOR BUSINESS OWNERS!

Texas is at it again:

Texas-based federal court issued a sweeping order prohibiting the federal government from enforcing the Corporate Transparency Act (CTA) anywhere in the country.

This is the first federal district court in the country to issue a nationwide injunction.

It is expected that the government may seek an expedited appeal of the decision and request a stay of the order of the federal district court (meaning enforcement by businesses would still be required).

If that happens - business owners would still need to comply by January 1. This puts all of us in a tough situation.

We will keep business owners posted as to the outcome of this legal battle. Our current recommendation is for business owners who have not yet filed the report to have their information ready and be alert for updates.

Maybe 2025 will be a boring legal year for business owners but 2024 certainly has not been.

Breaking News for Employers
(I know….we can’t take any more breaking news)

This one is actually good news:

The Court vacated and set aside the U.S. Department of Labor (DOL)’s final regulation increasing the salary threshold under the Fair Labor Standards Act (FLSA) on a nationwide basis.

The salary minimums will go back to the 2019 rates. It’s always possible there will be an appeal but with the recent party change in Washington, it’s unlikely.

We’ll put more out next week but we have many clients wrestling with the pending January increases, so I thought an urgent update would be prudent.
