9 counts of CSC dismissed today! 6 counts of CSC 1st degree and 3 counts of CSC 2nd. It Took 2 years for the prosecutor to charge. Client was cooperative from the beginning. Passed private polygraph with flying colors. Sat with police detectives twice and answered all of their questions. Provided police with evidence that would exonerate him. Police and prosecuting attorney gave their word to inform us if charges were issued so that we could turn him in to avoid the stigma, trauma and damage to his reputation as he was a business owner and sole breadwinner for his family and provided employment for his employees. One prosecutor declined to issue charges. Then 2 years pass and out of the blue, police wait and arrest him in front of his co-workers and his family Never notifying his attorney that a different prosecutor had a change of heart and issued charges. 9 of them!! 25 years to Life offenses! After charges are issued and multiple court appearances, prosecutor did not produce client’s accuser. We asked the court for justice and the Court dismissed the case. Today was a good day for justice. Can you imagine having to live with false allegations of the worst most despicable act to a child hanging over your head for over two years?! Imagine Having to spend thousands of dollars of your hard earned money that you can never get back, especially in the tough times we all have lived through in the past year, to defend against these allegations? Even Complying with everything that was asked of you by the government to Prove to investigators and prosecutors that you’re not guilty of the accusations and that you are willing to answer and do whatever they ask of you to prove that? Imagine that you trusted in the investigator’s word and prosecutors word that they’d notify you and your attorney if any charges were brought , instead you suddenly find yourself in jail with a $50k cash/surety (NOT 10%) bond to pay if you want to get out while your case is pending?
I am grateful that the Judge in our case did the right thing today and dismissed the case. Let’s hope the prosecutor does the right thing as well and doesn’t issue further charges on a case where the truth is obvious. The duty of a prosecutor or other government lawyer is to seek justice, not merely to convict. Although the prosecutor did not dismiss this case on her own, the Judge did. Today Justice was served.
