On May 25, 2023, the United States Supreme Court issued its Tyler v Hennepin County decision. This case will have a significant impact on Michigan tax foreclosures challenges. By unanimous decision, the United States Supreme Court ruled that Minnesota’s foreclosure statute (a strict foreclosure statute like Michigan’s) violated the United State Constitution’s Fifth Amendment by taking property without just compensation. This landmark decision recognizes for the first time that the Fifth Amendment protects property rights that the State Legislature simply cannot write out of existence.

This is a huge victory for our clients and all citizens.

We would like to put a spotlight on one of our employees, Mykaela! Mykaela started with us in July 2022 and has been helping us out around the office since. Today, she is working on separating and organizing stamps - a very valuable and important job at our office as we often send out hundreds of letters each week! Thank you, Mykaela, for being such a dependable, hardworking employee!

Visser and Associates achieved a significant win in its battle to obtain recovery for tax foreclosure victims, this past week.

The Counties have been asserting various reasons not to pay – including that the Michigan Supreme Courts 'Rafaeli' decision did not apply to those who lost their properties before the 'Rafaeli' decision. On September 22, the Michigan Court of Appeals firmly decided that 'Rafaeli' did apply retroactively to the benefit of those who lost their properties prior to 'Rafaeli.' (See Schafer, et al vs Kent County). This will assist thousands of people in their pursuit of justice.

One more obstacle removed as we continue our efforts on behalf of those damaged by these unconstitutional tax foreclosure policies.
