The battle to defend the Constitutional rights of thousands of Michigan residents continues.

Pung v Isabelle County was argued by Attorney Phil Ellison and Pacific Legal Foundation, our partners in this fight. We are proud of the efforts they put forth in advocating for Michiganders.

Justice Thomas: "What Isabella County did to the Pungs was wrong, and, on my initial view, likely unconstitutional."

Although the Supreme Court rejected our claim that the Pungs deserve fair market value compensation, the Court also vacated the lower court ruling against them.

Isabella County, Michigan seized the Pungs’ home — assessed at nearly $200,000 — over $2,242 in taxes the family never owed, then sold it at auction for just $76,000. The Pungs argued they deserved just compensation for the property value, not a depressed auction price.

The Supreme Court held that the correct baseline for measuring “just compensation” following a tax sale is the auction sale price, not the property’s hypothetical fair market value, at least when the sale is fairly conducted in light of the country’s history of tax sales.

Despite rejecting the Pung’s argument on what constitutes just compensation, the Court vacated the lower court ruling against the Pungs, allowing the family the opportunity to prove the county’s sale of their home wasn’t fairly conducted.
