The militarization of law enforcement is a problem that frequently leads to tragedy. It creates an us vs them mentality where officers rush to violence and/or judgment prematurely and the shooting of Airman Fortson is a prime example. While we do not know all the facts of the case here, on the surface it seems as if the officer is wrong and it cost a service member their life.

As an American, I should be able to answer the door of my castle (while holding a neutrally positioned firearm in my hand) without being executed for it by an agent of the government.

As a Criminal Defense Attorney and a Marine Corps Veteran, I am frequently disappointed and outraged by the things I see the government do and get away with because the behavior is so contrary to ideals I served to uphold.

Law enforcement's militarization needs to be corrected or tragedies like this will continue. We live in a time where many of our rights are under attack by an overbearing and controlling government. Let's hope the family of this young man can find some sort of justice and create some positive change from this tragedy.

Accidental or not, whenever the government can do something to one person without consequences, they can do it to anyone.

Apparently one of my appeals has been scheduled for oral argument at the Texas Court of Criminal Appeals in May.

For those who don't know, that is the highest criminal court in Texas.

Looks like I have some work to do.

A good criminal defense attorney knows all the tools in their toolkit. One of those tools is asserting the right to a speedy and public trial. I have yet to have a case where something does not change almost instantly when that right is asserted. It is however a potentially risky endeavor and sound judgment must be employed when doing so.

Today I had a client with 6 felony allegations dismissed because we spent the last 2 years proclaiming their innocence and pushed for a speedy trial. The government's case was terrible and the complaining witness should be charged for filing false accusations.

The risk of asserting speedy trial however sometimes entails getting an actual trial. Strategy for employing speedy trial demands are complicated and differ for every case. The justice system will ignore and swallow your rights unless you assert them. Speedy trial is another way to call the government on its poor behavior. In the right circumstances it might just help get your case dismissed too. Law Office of Jeff Shearer PLLC

Trials are often an unpredictable endeavor because of factors involving witness behavior, the judge, juries, and scheduling challenges, to name a few. Whoever you end up hiring should be familiar with the dynamic and complex nature of trial work.

Well the past few months have been pretty busy for us but we are now ready to share the big news. We have officially relocated the firm to Granbury, Texas, and will be right across the street from the Hood County Jail.

Granbury, Texas 76048.

We are sad to be leaving White Settlement because it was so supportive and welcoming. This move however was necessary to grow the firm in accordance with our original vision of primarily focusing on criminal defense matters.

Well I just completed some excellent training this past week at the Tim Evans Trial College with the Texas Criminal Defense Lawyers Association.

I learned a great deal of trial strategy and tactics. More importantly, I further developed my practical skills for the benefit of my clients.

During the course of the training, I met some great attorneys who are fighting the good fight elsewhere in the state.
