A driver hit you while you were walking. Here’s what most people don’t realize: you may not need their insurance to recover.

In California, your own auto policy can follow you onto the sidewalk. Uninsured motorist and medical payments coverage often apply even when you’re on foot — including in hit-and-runs where the driver is never found. The key is making a connection between use of your vehicle and the injury, which must be more than trivial or remote under the law. This analysis will likely require legal expertise.

Also, even if a police report suggests you were partly to blame, that doesn’t close the door. California lets injured pedestrians recover even when they share some of the fault.

Most people assume a driver who walks away means a claim that walks away with them. It usually doesn’t.

Insurance companies are increasingly using AI software to evaluate injury claims and estimate the lowest amount an insurer can offer while still closing a file. The algorithm doesn’t know your pain, your missed work, or how your injury has changed your daily life.

These systems also scan public social media activity, pulling photos, check-ins, and posts, looking for anything taken out of context to argue against your claim.
