So this is fun info! I had NO IDEA how many of my clients think a TAX RETURN is called a RETURN because you get a "RETURN" of your overpaid taxes. NOPE! The money you get back is called a REFUND - not a RETURN. Don't worry, it's about 80% of you that misunderstood the meaning.

The term "TAX RETURN" evolved from the legal usage of "return". When an official is served with a writ of habeus corpus (for example) demanding the release of an individual who is being held in custody without just cause, and the official responds to the writ showing the just cause for which the individual is being held, the documented response is called a "return" of the writ.

Similarly, the provisions of the Internal Revenue Code impose a tax liability on US persons, and the "return" is the means by which US persons provide their legal response that documents their actual tax liability. In this context, "return" is taken in its meaning of "legal report". The term "RETURN" has absolutely nothing to do with getting a RETURN of your money.

NEW IRS TOOL TO HELP NON-FILERS REGISTER FOR ECONOMIC IMPACT PAYMENTS

A lot of friends and clients have asked me how they get their stimulus payments if they have not had to file tax returns for 2018 or 2019:

Yesterday the Treasury Department and IRS launched a new free and easy online tool that enables those who don’t normally file a tax return, or have too little income to file, to register for Economic Impact Payments (EIP) so they can receive their payments faster.

The tool is available only on irs.gov; users should look for the Non-Filers: Enter Payment Info Here button; there is also a link or their homepage.

Who should use the Non-Filers tool: The tool is designed for people who did not file a tax return for 2018 or 2019 and who don't receive Social Security retirement or disability benefits or Railroad Retirement benefits. Others who should consider using the Non-Filers tool include:

1. Low-income individuals who haven't filed a 2018 or 2019 return because they made under the $12,200 for individuals and $24,400 for married couples’ threshold.

2. Veterans beneficiaries and Supplemental Security Income recipients.

3. Social Security, SSDI and Railroad Retirement beneficiaries with qualifying dependents under the age of 17.

4. Students who have not been claimed on someone else’s tax returns.

How to use the Non-Filers tool.

For those who don't normally file a tax return, the process is simple and only takes a few minutes to complete:

1. Go to Non-Filers: Enter Payment Info.

2. Create an account by providing your email address and phone number; and establishing a user ID and password.

3. Input your filing status (Single or Married filing jointly) and personal information.

Note: Make sure you have a valid Social Security number for you, your spouse, and any dependents.

4. Check the “box” if someone can claim you as a dependent or your spouse as a dependent.

5. Complete your bank information (otherwise IRS will send you a check).

6. Enter personal information to verify yourself. You will need your driver’s license (or state-issued ID) information. If you don’t have one, leave it blank.

7. You will receive an email from Customer Service at Free File Fillable Forms that acknowledges you have successfully submitted your information.

IRS TAX DEBT COLLECTION MORATORIUM - A Tax Resolution Holiday Opportunity

Did you know there is an unwritten IRS tax debt collection moratorium from December 3rd to January 2nd every year? During the holiday season, the IRS generally issues no tax liens, enacts no bank levies, issues no wage garnishments and executes no asset seizures. Although not an official policy, it has become a matter of record year after year for decades that the IRS takes no tax debt collection action during the holiday period at the end of each year.

PROTECT YOURSELF WHEN MAILING TAX RETURNS, TAX COURT PETITIONS AND TIME SENSITIVE TAX DOCS!

No one wants to be in a game of "he said, she said," especially if it involves the delivery of important tax returns or Tax Court documents. Using the proper mailing procedures provides proper evidence the documents were delivered. Simply put, this means that it's up to the IRS or the Tax Court to prove they weren't delivered.

Recently issued IRS regulations make it clear that only the proper use of registered or certified mail through the United States Post Office or a similar service provided by an IRS-approved private delivery service (PDS) will qualify as prima facie ("on its face") evidence of delivery.

Be aware that you may do yourself harm if you try and use a "better" US Post Office delivery method that registered or certified mail. For example, a Signature Confirmation may seem stronger, it will not shift the burden of proving the delivery onto the IRS or US Tax Court.

The IRS rejected, as "beyond the scope of its authority", suggestions to extend the prima facie evidence of delivery to mail sent using other US Post Office services, including Priority Mail, Certificate of Mailing, Express Mail Receipt, Delivery Confirmation Receipt, and Signature Confirmation.

The following private delivery services are currently approved by the IRS for purposes of both the delivery rule and the timely mailing rule (as in, you can mail a tax return on the April 15th due date, or on the day a Tax Court Petition is due):

DHL EXPRESS (DHL): DHL Same Day Service; DHL Next Day 10:30 am; DHL Next Day 12:00 pm; DHL Next Day 3:00 pm; and DHL 2nd Day Service;

Federal Express (FedEx): FedEx Priority Overnight, FedEx Standard Overnight, FedEx 2 Day, FedEx International Priority, and FedEx International First; and

United Parcel Service (UPS): UPS Next Day Air, UPS Next Day Air Saver, UPS 2nd Day Air, UPS 2nd Day Air A.M., UPS Worldwide Express Plus, and UPS Worldwide Express.

So do yourself a favor and use one of those three companies, or send returns or petitions via registered or certified mail though USPS.

FEDERAL TAX LIEN AVOIDED! In virtually all cases, anyone owing more than $25,000 in federal taxes to the IRS is subject to a federal tax lien filing, which like a bad credit report, virtually destroys your credit rating.
