DMV hearings in DUI cases are hard to win. If you have a refusal case alleged, meaning the officers say that you refused to submit to a chemical test after your arrest, and if you have a prior conviction for a DUI charge in the last 10 years, then you are facing a 2 year license suspension with NO ability to get a restricted license. We just finished a DMV hearing where our client was facing exactly that, a 2 year license suspension.

After many appearances at the DMV hearing, and multiple police officers testifying, the DMV hearing officer concluded that our client was not properly admonished by officers and therefore no refusal can stand. Suspension set aside!

We want to shout out our thanks to the DMV hearing officer (without naming any names of course) for doing the right thing! Thank you for your understanding of our argument!

One must realize, the standard of proof at the DMV administrative per se hearing is very low, a preponderance of the evidence, so convincing the government in these types of cases to render a decision favorable to the client, is no easy task by any measure. We also want to thank all officers involved for their honest and truthful testimony.

What started with an attempt murder arrest with client facing life in prison... ended up settling today (after 6months of hard work) for a misdemeanor assault charge with no jail time! A good lawyer knows how to properly investigate the facts and can present all the problematic issues to the prosecutor and twist their arm into settling for a lot less!

Yesterday in the Lancaster courthouse LA Defense Team saved a Vietnam Veteran who was awarded the Purple Heart from going to prison for 4 years. The Veteran had a 4 year ESS (Joint suspension) and he violated probation. The Prosecutor wanted 4 years and the Judge was ready to impose sentence. It took 5 or 6 court appearances and pulling a rabbit out of my hat, but he will not be going to state prison.
