When you get divorced, you have already begun to emotionally detach by virtue of making that decision.

The things that kept you together in the marriage are no longer there, so there is no reason to stay emotionally attached to your ex-spouse. Time usually cures it, and sometimes therapy helps if you need it.

Arguing in front of your kids, particularly about the divorce, is the worst thing you can do.

Many parents think the children are in the other room and do not know what is going on. That is a terrible mistake. Kids know everything. Always assume they hear and understand exactly what is happening.

The family home is often the biggest — and most emotional — asset in a divorce. So who actually gets to keep it? Arizona law has a clear process for figuring that out, and it might surprise you. We broke it all down in our latest blog: https://bit.ly/3PfFzlf

Arizona does not have formal arbitration for divorce cases, but parties can agree to appoint a third party to act as a judge.

That person can hear the case and enter final orders that are enforceable in court, and the person appointed is typically a retired family court judge.

If a parent refuses to follow a legal decision-making or parenting time order in Arizona, that is contempt, and it is punishable by jail time.

Jail is very rare though. What typically happens when violations are significant enough is that the parent who violated the orders loses legal decision-making authority or parenting time rather than going to jail.

It is always better to negotiate than to go to court.

And real co-parenting means listening more than talking. Many parents think that sending constant emails and text messages to the other parent is co-parenting. It is not. Co-parenting means actually listening to what the other parent says and considering whether it makes sense.

There are three common ways to pay a divorce attorney in Arizona: take money from a joint account, which is treated as a credit against your share of that account; withdraw from a retirement account like an IRA; or borrow from family members.

Borrowing from family is very common, but that obligation remains yours alone and is not divided by the court.

The main benefit of collaborative divorce in Arizona is money.

You hire one person to work through the issues with both of you, it typically goes faster, and it costs less than traditional litigation. But collaborative divorce will never work unless both parties are willing to collaborate, and in the experience of Arizona family law attorneys, that willingness is very rare.
