Understanding Your Rights: Arbitration Agreements in California Employment

In California, many employers require employees to sign arbitration agreements as a condition of employment. These agreements often waive an employee’s right to bring disputes to court, requiring them instead to resolve workplace issues through private arbitration. While arbitration can sometimes be faster and less expensive than litigation, it can also limit an employee’s legal rights and remedies. If you’re facing an arbitration agreement at work, it’s important to understand your rights under California law.

SETTLEMENT ALERT 🚨

Shiraz Simonian represented a client in her wrongful termination and race discrimination case against an employer whose headquarter was located in Hong Kong. The client, a Chinese-American Chief Marketing Officer, was demoted and had her salary reduced after the employer's CEO expressed a preference for a "white" face to represent the company in the U.S. She later faced a hostile work environment, retaliation, and was ultimately terminated after reporting discriminatory conduct.

Mr. Simonian filed a lawsuit alleging race discrimination, whistleblower retaliation, and wrongful termination against the employer and was able to settle his client's claims for $200,000 without prolonged litigation.

After fiercely advocating for his client in a case involving workplace discrimination based on sexual orientation and wrongful termination, Shiraz Simonian successfully overcame the other side’s demurrer—a legal challenge where the defendant argued that our case should be dismissed before even going to trial. By defeating this attempt to throw out the lawsuit, Shiraz was able to prove the strength of his client's claims in court. His unwavering commitment to justice led to a $250,000 settlement, ensuring accountability and securing a meaningful resolution for his client. This victory reaffirms Shiraz's dedication to fighting for employees who face unlawful treatment in the workplace.

Love & Labor Laws: A California Valentine's Tale

Cupid, dressed as an HR rep, hovered over California Labor Code and Wage & Hour Laws, who were on a candlelit date—romance, but with mandatory meal breaks.

Across the office, the Employee Handbook nervously offered a bouquet to PTO Policy. “Want to review time-off accrual over dinner?” Sparks flew—legally compliant ones.

Cupid sighed, stamping Fair Pay Act on the couple. “No retaliation for workplace romances… unless it violates wage laws.”

Meanwhile, Labor Code gazed at Wage Laws and whispered, “You had me at ‘non-exempt.’”

Ah, love—always subject to state regulations.
