Hovanes Margarian Attorney, entrepreneur and community advocate. Hovanes Margarian, Esq. USC - Biological Sciences, B.A; USC - Gould School of Law, J.D. Admitted to the California State Bar, U.S.
(1)

Ninth Circuit Court of Appeals and U.S. District Court for the Central District of California Hovanes Margarian is lead trial counsel and founder of a preeminent consumer protection law office in Sherman Oaks, CA. Margarian has extensive litigation experience in consumer fraud, automobile dealership fraud, automobile repair fraud, products liability, automobile defects/lemon law, legal and medical malpractice, business law, criminal law, employment law and personal injury litigation. He has litigated cases against Intel Corporation, Toyota Motor Sales, USA, Inc., Honda North America, Inc., Aston Martin Lagonda of North America, Inc., BMW of North America, LLC, Mercedes-Benz USA, LLC, Keyes European, LLC, Rusnak Enterprises, LLC and Wells Fargo Auto Finance, Inc. His clients range across the socio-economic spectrum, from the working class to the corporate elite. What unifies them is Margarian's vision that even poor individuals should afford the full legal remedies available under the law if they have been wronged. Margarian earned his undergraduate degree in biological sciences from the University of Southern California in a total of three years, while concurrently conducting scholarly research in gene therapy and earning the highest departmental awards for two consecutive years. Upon graduating from USC, Margarian combined his intellectual capacity with his relentless passion for standing up for the right cause and matriculated in law school, rejecting his admission to a tier one medical school.*1* Margarian obtained his Juris Doctorate degree from the USC Gould School of Law, where he concentrated his studies on business and corporate law, real estate law, property law and California civil procedure. While in law school, he co-founded a nationwide automobile sales and leasing brokerage. His venture in the automotive industry gave him first-hand exposure to the innermost nuances of automobile sales and leasing, which are rarely accessible to the public. While enhancing his professional network, Margarian built bridges with industry and community leaders, government officials and prominent attorneys. At the same time Margarian became involved in a graduate student association through which he developed charitable programs that rose over $30,000 annually and donated the funds to build schools and hospitals in underdeveloped regions of the world. Immediately upon graduating, Margarian established his own legal practice and quickly began gaining recognition for being an aggressive litigator with an unprecedented amount of inside knowledge of the automotive industry. He has a keen ability to assess damages in a given case and find legal theories under which to seek not only the client's actual damages but also punitive damages and attorney's fees and costs. This makes it possible for a consumer to afford retaining his legal services and vigorously pursuing a claim even when the consumer cannot afford to pay litigation expenses out of pocket. *2* Margarian is now widely known as one of the most bold litigators in the arena of automobile dealership fraud and auto defects/lemon law who gets most of his cases through referrals from other attorneys across the State of California. He has not only gained recognition from his own clients but also from defense counsel who routinely settle cases with him merely to avoid going to trial and often times even refer him clients. With the extensive amount of success and knowledge in litigation he has also expanded his practice into most major arenas of civil litigation including, but not limited to, legal and medical malpractice, business law, employment law, personal injury litigation and also criminal defense. Margarian frequents speaking engagements where he informs university and law school students regarding the practice of law and civil litigation involving fraud. He also lectures to the public on the topic of consumer fraud, educating them on how to better protect their interests. Margarian also hosted a popular television series that discussed consumer rights and remedies arising out of automobile dealership fraud, business law, employment law and criminal law. Margarian is past president and re-founder of the USC Downtown Los Angeles Alumni Club with a base of over 10,000 local alumni. During his presidency, he organized various social, networking and fundraising events in conjunction with the USC Alumni House. He is presently on the USC Gould School of Law Young Alumni Committee, is the co-founder and vice-chairman of the USC Armenian Alumni Association, and is involved as a member of the Consumer Attorneys Association of Los Angeles. As a member of the Board of Governors of the Armenian Bar Association, Margarian has organized events honoring high ranking government officials, judges, litigators, prominent businessman and others. Margarian’s new YouTube series is scheduled to launch in the summer of 2011, where he plans to share more of his legal knowledge by providing insight into various consumer interest topics. He is also authoring a series of books to empower consumers through legal and practical advice. ---------------------------------------------------------------------------------------------------- *1* Margarian's initial career objective was to become a pediatric cardiothoracic surgeon thus he studied biology as an undergrad at USC and conducting research in gene therapy studying the practical application of the HIV and FIV modules to cure AIDS at the Children's Hospital in Los Angeles. He was awarded the highest departmental awards for two consecutive years, the Milo Don Appleman Award and the Okin Award, and his research findings were published in the prestigious Molecular Therapy Journal of the American Society of Gene Therapy. Margarian's first scientific research project was a breakthrough in microscale techniques in thermodynamics which he published in the scholarly Journal of Chemical Education at the age of fifteen. He also graduated high school with the highest weighted grade point average of 4.72 in the State of California in the year of his graduation. *2* Shortly upon starting his legal practice Margarian substituted in as lead counsel on two major ongoing litigations involving dealer fraud. The first one involved a $200,000 recreational vehicle purchase. The matter was set for trial three weeks away and Plaintiff's counsel had done zero preparation, even advising him to walk away from the case after having expended an exorbitant amount of money and nearly eighteen months. Margarian took over the matter, prepared for the trial and successfully recovered nearly one quarter of a million dollars. The second matter involved a $120,000 high-end sports vehicle, a working class Plaintiff who had hired a real estate attorney to represent him, over two years of ongoing litigation, a multi-million dollar defendant with top notch legal counsel and yet no end in sight. The underlying case was valued at $40,000 however Margarian recovered double the amount by proving not only the selling dealership's liability but also crucial errors made by the client's prior counsel.

Excited to announce a $144,100 judgment entered today on one of my cases after 3 years of litigation. You can run but you cannot hide! It is especially vindicating that the judge granted 100 % damages, interest, attorney's fees and costs. I admire the judges who value the work we do - the time and funds we expend to fight for consumers' rights on pure contingency. The system does work. This was a case which could have been resolved by the defendants 3 years ago for $20,000 to $30,000. I suppose they needed to learn a lesson the hard way. - Hovanes Margarian, Attorney At Law

2014 Margarian Scholarship Application

I am pleased to announce the 2014 Margarian Scholarship. The purpose of this scholarship is to reward a select number of diverse and deserving students for their academic and personal achievements. You will notice that the application is simple and broadly designed to give you the opportunity to present the reasons as to why you are one of those deserving individuals. In addition to academic accomplishments, I am seeking candidates who have demonstrated a commitment to their heritage, community and society. Persistence, dedication, idealism, perseverance, success and humility are just some of the characteristics which I had in mind when designing this scholarship. Note that this scholarship will not be determined solely on the basis of G.P.A. or economic hardship. I am seeking the most deserving candidate based on a multitude of factors. The scholarship will be in the form of a check payable to the recipient and may be applied towards past, present, or future tuition expenses. The scholarship prizes will consist of five (5) awards of $1,000 each.

My legal practice focuses on the arenas of class actions, automobile dealership fraud, automobile defects/lemon law and criminal defense. I pride myself in having helped hundreds of clients and having recovered millions of dollars on their behalf. But like many, I too come from a humble beginning. At the age of thirteen I spoke poor English and failed my first pop-quiz because I did not understand what I was being asked. Since then, I earned my way through education – graduating valedictorian, attending USC on a full scholarship, conducting gene therapy research, publishing in scholarly journals, attending USC law school, running multiple student, charitable and professional associations, founding several business ventures and building a legal career and reputation that is an embodiment of my past. And so it is with all those experiences in mind that I chose to start what is becoming an annual scholarship fund to help those taking the same path. Not necessarily the path to becoming an attorney, but the path to bettering themselves with a clear vision for their future, while staying true to their past. I welcome your application and am truly excited to reward the right candidates who demonstrate their deserving of this award.

You may download the application online at:http://margarianlaw.com/scholarship/

Very truly yours,

FOR IMMEDIATE PRESS RELEASE
October 16, 2013

Sherman Oaks, CA – The Law Offices of Hovanes Margarian files a major class action lawsuit against BMW of North America, LLC, the company which manufactures BMW and MINI vehicles. The class action lawsuit, in pertinent part, alleges that over one million (1,000,000) vehicles were manufactured and retailed by BMW of North America, LLC with a defective Auto Start Stop system, which causes the engine to turn off when the vehicle comes to a complete halt and fails to re-start when the driver accelerates, creating a possibly life-threatening situation. Additionally, the defective Auto Start Stop system causes premature wear and/or failure of engine components. The condition is so severe in some vehicles that BMW of North America, LLC’s only solution is to permanently disable the Auto Start Stop function and charge some owners for the costs of labor in doing so. The lawsuit alleges that BMW of North America, LLC has been aware of this defect for years and yet has failed to provide a proper remedy to its customers. Moreover, BMW of North America, LLC has continued to manufacture and retail these vehicles without disclosing this material defect to the consumers.

Hovanes Margarian, Esq., the lead attorney for the class action case, states, “We suspect that millions of consumers have lost time from work and suffered financial loss due to this defect. We also believe that BMW and its affiliated dealerships have conspired to avoid documenting complaints by many consumers and have engaged in a campaign to avoid recalling these vehicles by paying off individual consumers who have filed complaints.” While Margarian is not at liberty to divulge the full details of the evidence against BMW, he is confident that the evidence against BMW is overwhelming. “Many BMW and MINI drivers have been told that their complaints regarding the defective Auto Start Stop function have been unverified and many have been refused documentation of their complaints,” states Margarian. Under most state lemon laws, a consumer must have documentation of his/her visits to a dealership in order to be able to subsequently make a claim for a refund under the lemon law. When dealerships systematically fail to document visits, that results in the consumer being unable to utilize his/her rights under the state lemon law as he/she has no means to prove that the dealership had multiple opportunities to repair the vehicle. “As part of this lawsuit, we seek not only to provide a remedy to BMW and MINI drivers who have been harmed to date, but to also ensure that BMW of North America, LLC enforces stricter documentation guidelines at its dealerships so that consumers’ rights are not restricted in the future,” states Margarian.

The estimated amount of the claim within this class action lawsuit exceeds one billion dollars ($1,000,000,000). The lawsuit was filed yesterday in Los Angeles Superior Court, Central District. The lawsuit will likely be removed to Federal Court, in light of the fact that it affects millions of BMW and MINI vehicles sold in not only California, but the entire United States. The Law Offices of Hovanes Margarian is a preeminent firm in the arenas of automobile defects, automobile dealer fraud, CA lemon law, consumer protection and class action litigation. FOR IMMEDIATE PRESS RELEASE
September 30, 2013

Sherman Oaks, CA – The Law Offices of Hovanes Margarian files a major class action lawsuit against Volkswagen Group of America, Inc., the company which manufactures Audi and VW vehicles. The class action lawsuit, in pertinent part, alleges that an estimated five million (5,000,000) vehicles were manufactured and retailed by Volkswagen Group of America, Inc. with defective engines which cause overconsumption of oil. The condition is so severe in some vehicles that drivers are required to top off the engine oil every three (3) weeks or else risk ruining their vehicles’ engines. The lawsuit alleges that Volkswagen Group of America, Inc. has been aware of this defect for years and yet has failed to provide a proper remedy to its customers. Moreover, Volkswagen Group of America, Inc. has continued to manufacture and retail these vehicles without disclosing this material defect to the consumers.

Hovanes Margarian, Esq., the lead attorney for the class, states, “We suspect that millions of consumers have lost time from work and suffered financial loss due to this defect. We also believe that VW and its affiliated dealerships have conspired to avoid documenting complaints by many consumers and have engaged in a campaign to avoid recalling these vehicles by paying off individual consumers who have filed complaints.” While Margarian is not at liberty to divulge the full details of the evidence against VW, he is confident that the evidence against VW is overwhelming. “Many VW and Audi drivers have been told that the oil consumption is normal and many have been refused documentation of their complaints,” states Margarian. “As part of this lawsuit, we seek not only to provide a remedy to VW drivers who have been harmed to date, but to also ensure that VW enforces stricter documentation guidelines at its dealerships so that consumers’ rights are not restricted in the future,” states Margarian.

The estimated amount of the claim within this class action lawsuit exceeds one billion dollars ($1,000,000,000). We are delighted to announce the winners of the 2013 Margarian Scholarship. The selection process was extremely difficult in light of the large number of highly qualified applicants. We were pleasantly surprised to have over 100 applicants, many of whom had stellar academic records, extensive community service records and a clear devotion to the Armenian heritage. Nevertheless, we had to select only five (5) winners.

And the winners, in no particular order, are:

- Ara Yeghikyan from Yerevan, Armenia: 2 years of military service on the front line in Artcakh, stellar academic record at University Jean Moulin Lyon, France, French University of Armenia, Armenia, Yerevan State University, Armenia, participation in many human rights organizations/NGO's, and much more.

- Hayk Mamajanyan from Yerevan, Armenia: associate attorney at one of Armenia's premier international firms, Arlex International, stellar academic record at Yerevan State University, Armenia, National Academy of Sciences of Armenia, Armenia, and University of Oxford, England, various publications and involvement in pro bono services, and much more.

- Ofelya Tevosian from Los Angeles, CA: multitude of awards and recognitions, stellar academic record in high school, college and at USC, extensive volunteering/internships, and much more.

- Emma Dishoian from Los Angeles, CA: multitude of awards and recognitions, stellar academic record in high school and college, UCLA undergrad admitted, extensive community service, and much more.

- Rafik Mughnetsian from Los Angeles, CA: multitude of awards and recognitions, stellar academic record in high school and at UCI, extensive community service including service to the Western Diocese of the Armenian Church, and much more.

We hope that our humble $1,000 contribution to these individuals’ education will help ease some of their financial burdens and allow them to continue to excel, as they have to date. We also hope that those who were not selected for the award are not disheartened by the results. In the process of reviewing applications, interviewing some of the semi-finalists, and trying to narrow down the list, we realized that the biggest reward we could give the applicants was not the modest financial award, but the opportunity to meet their fellow applicants - the brightest, most driven, and most culturally aware young Armenians. Armenian who all exhibit a passion and a clear dedication for the Armenian heritage, culture and nation. The cliché of power in unity and strength in knowing the right people truly resonated in our mind. So it is with this vision that we invite all applicants to attend the awards reception in August of 2013 (details to be announced).

In addition to all applicants, we will be inviting established and prominent members of the Armenian community from various fields to attend the reception. The event will give you an opportunity to network and establish future internship, mentorship and job opportunities.

We sincerely extend to all applicants our guidance and support in all your future academic and career endeavors. We see you as the future of our community, of Armenians both in the Diaspora and in our homeland. Your individual success, coupled with your devotion to our common cause, is the ultimate way to bring salvation to the Armenian people.

In light of the extremely competitive applications, we have revised the categories to award five (5) individuals with equal $1,000 awards. It would be unfair to distinguish between the five (5) recipients, as each of them has demonstrated merits of equal value.

Once again, we congratulate the scholarship award recipients and look forward to meeting you all at the reception.

Very truly yours,
2013 Margarian Scholarship Committee
