Huge progess for legal gun owners this week. The Southern District of Illinois rules that Illinois' assault weapons ban is unconstitutional under the 2nd and 14th. This ruling is significant because unlike the previous failed challenges this one went to a week long trial. The weapons ban is now in the hands of the 7th Circuit. What standard will they use to review? Well that's the million dollar question. De Novo? Clearly erroneous? Abuse of Discretion? I opine it will be De Novo (the best for the Appellant) because it's a question of law and not fact but nonetheless it's an encouraging time for legal gun holders in Illinois.

Kudos to our General Assembly making tomorrow a State Holiday. "General Election Day". Kids home from school, State facilities closed, Employers legally required to give at least 2 hours to each employee time off to Vote. All very cool stuff! I support the signal of this day's importance.

I was the Judge of the best Witches Hat last night at the BAWIB Chapter of the Chamber of Commerce event. Wellness in Wheaton embodied the full spirit of the event so hats of to her and her and her cool creative hat. As a Local Real Estate Attorney this Prarie Lakes (formerly Indian Lakes) project makes me very happy for the surrounding Communities and all of the local business and employment that a new modern Golf Course, Hotel, Resort, Restaurants, will provide!

Indian Lakes Resort faced an uncertain future when the hotel property went up for sale two years ago. But the Frank Lloyd Wright-influenced resort is showing signs of new life as hotel renovations progress and Bloomingdale leaders finalize plans for a golf course redo.

Friendly reminder to all of my REALTOR partners and Investor Clients.... As of January 1, 2023 you can no longer reject a Tenant because they have a Section 8 Voucher. PSA...if you have any current or old marketing stating as such take it down ASAP!!!!

Source of Income is now a protected class in Illinois Housing Discrimination Law. This means that most sources of income cannot be used as a basis to deny a Tenant from your Rental. So income from Section 8, Homelessness Prevention, Child Support, Social Security, Retirement, Disability, etc. etc. are impermissible reasons to deny an applicant. (Yes, the giant pile of cash from criminal activity can still be a reason for denial! šŸ˜‚šŸ˜‰)

Source of Income is how an individual legally receives their money in order to pay for their housing.

Just in...RE/MAX and Anywhere RE Group (C21/CB/Sotheby's etc.) pays $55M and $83M to settle Class Action Lawsuit.

Q to all of my REALTOR partners....
Has your firm been discussing the possibility of massive changes to our sector? RE/MAX has stated it will no longer mandate the Buyer's REALTOR to be compensated by the Seller. Scary thoughts!!!

NAR refuses to settle and is going to trial very soon. Losing is estimated to cost over $40B and would no doubt shake-up our industry, especially in the Chicago markets.

POV... consumers are better protected and save money with a Buyer's side REALTOR. This Anti-Trust Lawsuit has the potential to force Re/Max, CB, C21 etc. to substantially reduce or even eliminate Buyer's REALTOR commissions.

As Sheriff, I feel that my own 1st amendment constitutional right to free speech has been completely trampled on by a governor who has threatened my Offices’ reimbursement and grant funds as a tool to force me not to speak. I just can’t do this any more. I stand with our citizens and businesses of DuPage County who have offered no trouble or no resistance to any rule we put upon them, no matter how strange. In fact they have communally helped to support us during this pandemic with resources and physical help. I will not have a polarized and threatened society when we are currently experiencing nothing but great treatment from our citizens and businesses. We are not experiencing the same problems as Cook County. We can re-open responsibly and with proper care. We’re not just going to open up with no precautions but science suggests a potentially different route. We did all say from the beginning that we would follow science to the end correct? We have now created ā€œsuper hot spotsā€ for COVID-19 within our most coveted resources. Our primary food sources. (Costco,Jewel, etc). As our local restaurants continue to dissolve into oblivion, the reliance on food will cause more people to flock to the few that are open, causing very high potential virus transfer, food shortages and a potential collapse of our economy. If other businesses were opened responsibly, wouldn’t that take away from congregation at the only few places left open? This is what purely scientific minds have asked me. I’m just having difficulty with what looks like politics pitting everyone against each other and then wanting the police to arrest everyone who disagrees. We are not stormtroopers. We are peacekeepers. All these years, you have told us that you want law enforcement that thinks before arresting, doesn’t violate your rights and treats their citizens with decency. Now you have that and are asking us to regress into what you didn’t want and didn’t deserve. Please let us be the law enforcement you always asked us to be. Non oppressive. We are dealing with a serious rise in crime, new challenges in our correctional facility and a massive upsurge in our courthouse when everything opens back up. We will rise to the challenge. This is not the time to introduce fear into our society by threatening class A misdemeanors,but instead it’s a time to assist our citizens and businesses to get back on their feet. I feel DuPage County is ready to re-open responsibly before everything is gone and I will not victimize lawful residents of DuPage County trying to put food on their children’s table. I’m so proud of our DuPage citizens who have done everything right from the beginning. All I can say is thank you.
