🚨 Important Travel Advisory for Individuals in Removal Proceedings 🚨

It has come to our attention that certain individuals who are already in removal proceedings and still have right to international travel are being detained upon their arrival back in the US. In these uncertain times, we strongly advice to avoid traveling if you are currently in removal proceedings, as it may not be safe. ✈️

While removal proceedings mean that a judge has the authority to order your removal, it is still possible to be stopped and detained at the airport, even if you are simply traveling. ⚠️

If you are in removal proceedings, please consult with an experienced immigration attorney before making any travel plans.

Your safety and legal status are our top priorities. Reach out to our office for advice on how to navigate these situations and protect your rights.

🚨 Ongoing ICE Raids: Know Your Rights at Home 🚨

With ICE raids on the rise, it’s important to know your rights if ICE agents show up at your door. Here’s what you need to know to protect yourself:

🔑 ICE agents cannot legally enter your home without a valid search warrant signed by a judge. An ICE detainer alone does not give them the right to enter your home. To enter, they must either have your consent or a judicial warrant.

Key Points to Remember:
* Detainers are NOT warrants: An ICE detainer is simply a request for local law enforcement to hold someone until ICE can take them into custody. It does not give ICE the right to enter your home.
* You need a search warrant: ICE must have a search warrant issued by a judge to enter your home and make an arrest.

Without this, they cannot come inside.
Administrative warrants are limited: While ICE may have administrative warrants allowing them to arrest someone, they cannot enter your home based on these alone. You still have the right to refuse entry without consent.

🚪 What Can You Do?

1.Do not open the door unless ICE shows a valid, signed search
warrant.
2.Request to see the warrant through a window or under the door.
3.Check for the judge’s signature and your name and address.
4. You don’t have to speak: You can remain silent and request to speak with a lawyer.
Know your rights: Carry a ‘Know Your Rights’ card and share it if needed.
💼 If you’re detained, remember you have the right to an attorney and to contact your consulate.

Stay calm, stay informed, and protect your rights. If you or someone you know needs legal assistance, we’re here to help.

🚨 IMMIGRATION UPDATE: Practical Advice After President Trump’s Executive Orders 🚨

It’s been a few days since President Trump signed his executive orders on immigration, and we know many of you are concerned about what this means for your situation. As your trusted immigration attorneys, here’s some practical advice to help you navigate these changes:

1️⃣ Birthright Citizenship – Stay Alert:
The order limiting birthright citizenship has been challenged in court, so it’s still uncertain whether it will take effect on Feb. 19, 2025. For now, if you're expecting a child, continue to monitor any legal updates closely.

2️⃣ Refugee Admissions – Expect Delays:
If you're seeking refugee status, admissions are suspended for now. This could delay processing or affect your status. Keep in touch with your attorney for the latest on your case.

3️⃣ Border Enforcement – Be Prepared:
Stricter border enforcement means more scrutiny on undocumented individuals and travelers. If you’re living in the U.S. without legal status, consider seeking legal counsel immediately to assess your options and rights.

4️⃣ Visa Processing – Plan Ahead:
Visa applicants may face longer processing times and additional vetting, especially from high-risk countries. If you're waiting for a visa, be prepared for delays and document requests.

5️⃣ National Emergency at the Border – Know Your Rights:
The national emergency declaration could lead to increased enforcement at the southern border. If you plan on crossing the border, be aware of possible detentions or delays.

💡 What You Can Do Now:

Consult with an attorney: Whether you’re dealing with delayed visas, concerns about your status, or planning to travel, speaking with a professional can help you navigate these changes.
Stay informed: These orders are likely to be challenged in court and could change over time. Keep up with news and legal updates.
Document everything: Keep copies of all immigration documents, receipts, and communication with authorities.
We’re here to help you understand your rights and options during this uncertain time. If you’re worried about how these orders affect you, don’t hesitate to reach out!

🚨 What to Do If ICE Picks Up a Loved One: Important Information You Need to Know 🚨

If you or someone you know is detained by ICE, it’s critical to stay calm and act quickly. Here are the steps you should take:

1. Know Your Rights
Everyone has rights, even if they're detained by ICE. The person detained has the right to remain silent and the right to an attorney. They do not have to sign anything without legal representation.

2. Stay Calm and Gather Information
Try to get as much information as possible, including:

- The location where the person is being held
- The reason for detention
- Any relevant documents (court dates, charges, etc.)

3. Contact an Experienced Immigration Attorney
It’s essential to get legal help. An immigration attorney can provide guidance on how to challenge the detention, secure release, and navigate the legal process.

4. Don’t Engage in Illegal Activities
Never attempt to bribe or confront ICE agents. Keep your interactions respectful and legal.

5. Prepare for the Next Steps

- Understand the deportation process and the possibility of bond hearings.
- Stay connected with legal counsel and family members.
- Be cautious about sharing sensitive information on social media.

Remember, you don’t have to go through this alone. Our team at Kola & Associates LTD is here to help guide you through the immigration process and protect your rights.
