INITIAL STEPS IN THE ARIZONA DIVORCE PROCESS

When initiating a divorce in Arizona, the first step is filing the necessary paperwork with the court.

The individual filing for divorce is known as the “Petitioner,” while the other party is the “Respondent.”

The Petitioner is responsible for serving the Respondent with the divorce papers, outlining the reasons for the divorce and any requests for child custody, spousal support, or division of assets.

To avoid delays, it is important to ensure that all of the required forms are completed and submitted in accordance with court guidelines.

Schedule a consultation to discuss the details of the Arizona divorce process with a divorce attorney in Glendale or Mesa by calling Sullivan Shick PLC at the number below.

THE ROLE OF THERAPY AND COUNSELING IN DIVORCES RELATED TO SUBSTANCE ABUSE

Whether the substance abuse is a primary or secondary reason for the divorce or arises because of the divorce itself, substance abuse can have a devastating effect on the family, as well as the divorce itself.

However, if couples engage in counseling as part of their divorce process, they may be able to help the person who has the substance abuse issue as well as the entire family.

Counseling or therapy does not have to be done with the intention of preserving the marriage; it can assist in preserving the relationships that persist after the divorce is final.

REQUIREMENTS FOR COVENANT MARRIAGE DIVORCE IN ARIZONA

Arizona is one of the very few states that recognize covenant marriages.

For these marriages, obtaining a divorce is only possible for specific reasons, including adultery, felony conviction, abandonment for at least a year or if the spouse does not expect the abandoning spouse to return within 12 months, sexual or physical abuse, emotional or domestic violence, separation from the home for a minimum of two years, legal separation for a minimum of 12 months, alcohol or drug abuse, or agreement for the divorce on both sides.

While covenant marriages account for a relatively small percentage of Arizona marriages, individuals who find themselves needing to leave a covenant marriage may benefit from speaking with a Maricopa County divorce lawyer about the specifics of their situation.

Understanding The Standard Of Living For Alimony Purposes

Wealthy Arizonans tend to enjoy luxuries like expansive mansions, frequent vacations, and access to excellent healthcare.

Why Would A Divorce Go To Trial?

Many Arizona residents preparing themselves for a divorce find themselves looking at court forms and filing procedures and wondering, “Wait – why would a divorce go to trial?”

The answer is usually a combination of the core areas on which the divorcing partners struggle to agree as they disentangle their formerly shared lives and the legal requirements of Arizona divorce, under which certain questions must always be decided before the former spouses can go their separate ways.

IMPACT OF SUBSTANCE ABUSE ON CHILD CUSTODY IN ARIZONA

The struggling spouse’s behavior and lifestyle can adversely affect their chances in a custody dispute, especially if they have regularly engaged in dangerous or irresponsible activities while under the influence.

An added layer of concern arises if the addicted spouse also exhibits abusive tendencies.

In these unbearable situations, the other spouse must prioritize their safety, as well as the safety of their children.

An experienced Arizona family law attorney with Sullivan Shick PLC may be able to offer you guidance as you navigate this difficult part of your journey.

IS CHILD SUPPORT INCOME?

As a general rule, any income a parent receives “for the benefit of a minor child” is exempt from future child support calculations.

This includes not only child support, but also things like adoption subsidies, Supplemental Security Income (SSI), and any subsidies arising from the disability of a child.

A Mesa divorce attorney with Sullivan Shick may be able to help you evaluate your situation in a personalized consultation.

WHY DO LAWYERS RECOMMEND FORENSIC ACCOUNTANTS FOR HIGH NET WORTH DIVORCE?

Forensic accountants are experts at finding hidden assets or other financial issues that could complicate a divorce.

They are often brought in for high net worth divorces to ensure that there are no hidden, forgotten, or unrecorded assets that are left out.

Typically, one spouse or their attorney hires the forensic accountant because they suspect their spouse may be hiding assets or to evaluate a business or other significant assets and determine their value.

Connect with one of our experienced Arizona divorce attorneys to discuss whether you may need to consider hiring a forensic accountant in your high net worth divorce case.

Determining Child Support

As children are generally unable to advocate for themselves in these negotiations, divorce can threaten their sense of safety and lead them to worry about what might happen next.

This is why the family court system in the United States generally, and more specifically in Arizona, works to protect and give rulings to benefit the well-being of the child above other matters.

As such determining child support in Arizona will take into account factors of the income and earning capacity of both spouses and the financial needs and responsibility of raising and co-parenting a child.
