Who Pays the Bills During Divorce

One of the most frightening aspects about getting a divorce is your future finances. In Arizona, at the conclusion of the divorce, the parties community assets are essentially divided and final child support and spousal maintenance (alimony) orders are entered. But it can take months and sometimes a year or longer to finalize the divorce. So, what does your financial picture look like while the divorce is pending? Who pays the bills during a divorce or separation?

Ideally, the parties or their attorneys will reach an agreement as to how the bills will be paid while the divorce is pending. However, if an agreement cannot be reached, you or your attorney can file a Petition for Temporary Orders asking the Court to enter orders as to the bills that each party must pay while the divorce is pending. In making this decision, the Court will consider the income of each party, the monthly expenses and the needs of the children, if applicable. The Court will review your tax returns, paystubs, monthly expenses, costs for daycare or before/after school care and other relevant financial information to ultimately issue a court order for temporary spousal and/or child support.

In Arizona, you have the right to seek temporary support for paying bills while the divorce is pending. This can include expenses for a second residence, if one of the spouses has moved out and has expenses associated with their new living situation. Resolving the issue of how bills are going to be paid while the divorce is pending can be extremely stressful.
