Under 75 Pa.C.S. § 3802(d)(2), you can be convicted of a DUI in Pennsylvania if you are under the influence of any substance — including legally prescribed medication — to a degree that renders you incapable of safe driving. Unlike your home, your vehicle carries a lower expectation of privacy because it is in public view and mobile. This means law enforcement has more grounds to conduct a search without a warrant in certain circumstances.

Here’s what you should know:

✅ Consent — If you agree to a search, police do not need a warrant. You have the right to decline, and it’s important to understand that before saying yes.

✅ Probable Cause — If an officer has reasonable grounds to believe evidence of a crime is present, they may search without your consent.

✅ Lawful Arrest — A search may be conducted incident to a lawful arrest.

✅ Plain View — If contraband or evidence is visible in plain sight, it may justify a search.
