Attorney Kristin Suchy, a Partner at Griffin Williams McMahon & Walsh LLP, recently recovered in excess of $500,000.00 on behalf of a client against a decedent’s estate and restaurant business in Cook County. Despite not receiving the proper notices, Attorney Suchy discovered the pending probate proceedings of the decedent’s estate and filed a claim against the estate seeking repayment of a 13 year old unsecured oral loan for start-up funds for a restaurant.

The agreement and an acknowledgment of debt was memorialized seven years later, and was further documented by email and text conversations with the decedent. Despite her clients’ efforts during the decedent’s lifetime, they received only a negligible partial repayment of the debt. Attorney Suchy was able to separately recover funds from the restaurant (avoiding a pro rata distribution with competing creditors of the estate) and the decedent’s estate, maximizing her client’s recovery to 86% of the original loan amount. Attorney Suchy’s knowledge and experience in probate litigation and investigative efforts to prove-up the claim resulted in a significant recovery of funds for her clients.

Griffin Williams McMahon & Walsh's most recent appellate court victory on the issue of firefighter pension benefits is featured in this month's Fire Law Blog with Curt Varone:
https://www.firelawblog.com/2022/12/01/court-of-appeals-holds-that-terminal-leave-counts-toward-pension-credits/.”

The Appellate Court of Illinois has ruled that a former fire chief was entitled to pension credit for the four and one-half months he was on paid administrative leave prior to his retirement. The case involved the former fire chief for the Orland Fire Protection District, Kenneth Brucki.

We are pleased to announce that Kristin Suchy recently obtained a $395,000 judgment in federal court on behalf of two DeKalb residents against an outfit of illegal bounty hunters who lured our client and her husband to a gas station under the guise of a Facebook Marketplace transaction before taking her against her will at gunpoint and handcuffing her. They forced her into a vehicle and transported her to Mississippi to respond to charges related to her failure to appear in court stemming from a traffic violation. Bounty hunting is illegal in Illinois. 725 ILCS 5/103-9.

The incident wreaked havoc in the community with local police responding to a report of her abduction. Our client was five days post-partum and separated from her newborn child for several days as she remained in jail pending the resolution of her underlying case. The bounty hunters deprived our client of her privacy and dignity, and subjected her to endless harassment while under their captor. Our client suffered immense emotional distress during and following the incident. There is no amount of money that could right the wrong that was done to our client, but we are grateful that the flagrant and appalling conduct of the bounty hunters has been acknowledged by the courts.

The attorneys of Griffin Williams McMahon & Walsh LLP are zealous advocates for their clients and proudly pursue justice on behalf of injury victims.
