Do you have all five tools in your legal toolbox?

This week, I shared the **5 Legal Documents Every Senior Should Have**—and one of my favorite parts of this topic is that not every tool is right for every job.

For example, I don't believe every person automatically needs a trust.

A trust can be an incredibly useful planning tool when it solves an actual problem. But the conversation shouldn't start with, “Someone told me I need a trust.”

It should start with:

**“What am I trying to accomplish?”**

Avoid probate? Plan for incapacity? Make things easier for your children? Address long-term care concerns? Protect a beneficiary? Keep assets in the family?

Once we know the goal, we can choose the right tool.

**“My parents already have wills. Isn't that enough?”**

Usually, that's only part of the picture.

A will primarily tells us what should happen to certain property **after someone dies**. It doesn't solve one of the biggest questions families can face while a parent is still living:

**What happens if Mom or Dad needs help managing things?**

That’s where documents such as a Durable Financial Power of Attorney and Health Care Power of Attorney become so important.

And there’s another issue: even a perfectly drafted will may not control every asset. Beneficiary designations, joint ownership, and trusts can determine where certain property goes instead.

Estate planning isn't about checking the “I have a will” box.

It’s about making sure all the pieces work together—for you during your lifetime and for your family afterward.

đź’ˇ **DID YOU KNOW?**

Some of the most important estate planning documents have nothing to do with distributing your property after you die.

Your **Durable Financial Power of Attorney** and **Health Care Power of Attorney** are primarily there to help protect you during your lifetime.

Think about what would happen if you had a stroke, were injured in an accident, or spent several weeks in the hospital and rehabilitation.

The mortgage still needs to be paid. Insurance paperwork still arrives. Someone may need to deal with your bank. Doctors may need decisions made when you cannot communicate.

Who would step in?

And just as importantly—would that person actually have the legal authority they need?

Good estate planning isn’t only about preparing for what happens someday.

It’s about making sure there is a plan for **you** along the way.

**Why is probate taking SO long? ⏳**

If you've ever been responsible for settling someone's estate, you may have asked that question more than once.

The truth is, probate delays aren't always caused by someone dragging their feet. Sometimes the delay is built into the North Carolina estate administration process. Other times, you're waiting on a bank, trying to sell a house, tracking down an asset, dealing with creditors—or navigating family members who don't exactly agree on what should happen next.

And here's something I always want families to understand: a delay doesn't necessarily mean something has gone wrong. There may be a lot happening behind the scenes even when it feels like nothing is happening at all.

**“The Will tells us who gets the property. It doesn’t magically move the property from Dad’s name into the beneficiaries’ names.”**

That’s a distinction families don’t always realize until they’re actually going through probate.

A Will is incredibly important, but there is still work to be done after someone dies. Accounts have to be located. Financial institutions have their own procedures. Creditors have to be addressed. Property may need to be sold. Court requirements have to be met.

And someone—the executor—is responsible for making all of that happen.

Understanding what probate actually involves can make the timeline a little less mysterious and help families understand why “everything goes equally to the kids” doesn’t necessarily mean everything can be wrapped up quickly.

**IT’S A FACT**

⏳ **Some of the waiting in North Carolina probate is built into the process.**

After an estate is opened, the executor can’t simply gather the money and immediately divide it among the beneficiaries.

There are creditors to address, assets to identify and value, required court filings to complete, bills and expenses to pay, and sometimes property to sell. And that’s assuming everything goes smoothly.

Add a missing account, a house that takes months to sell, a creditor dispute, or family disagreement, and the timeline can get even longer.

Probate may *look* like nothing is happening. In reality, there can be a lot happening behind the scenes.

❓ **“How long does probate take in North Carolina?”**

This is one of those attorney answers that nobody loves:

**It depends.**

A relatively straightforward estate with organized records, cooperative beneficiaries, and uncomplicated assets is very different from an estate involving a house that needs to be sold, hard-to-find accounts, creditor claims, tax issues, or family disagreements.

There are also parts of the North Carolina estate administration process that simply take time. An executor has legal responsibilities to complete before everything can be distributed and the estate closed.

So instead of focusing only on *how long* probate takes, it can be more helpful to understand **what is actually happening during that time.**

**Did you know that an executor generally can’t just pay everyone their inheritance as soon as an estate is opened?**

North Carolina has a creditor process that gives creditors time to submit claims against an estate. That means even when an estate seems simple—and everyone in the family agrees about what should happen—there can still be waiting involved.

And creditors are only one piece of the puzzle.

The executor may also be waiting on banks, trying to locate assets, dealing with real estate, gathering tax information, or completing required filings with the Clerk of Superior Court.

So when probate seems like it is moving at a snail’s pace, there may actually be quite a bit happening behind the scenes.
