That includes bringing prohibited items such as a cell phone into the exam, continuing to write after time has been called, or looking at another applicant’s exam materials. Exam misconduct can trigger charges, investigations, and potential character and fitness issues that may affect bar admission.

What is reciprocal discipline for a New York attorney who has already been disciplined in another state?

Reciprocal discipline can apply when a lawyer is admitted in New York and another jurisdiction, and that other jurisdiction imposes professional discipline. New York may then begin its own proceeding and impose the same or comparable sanction.

In a recent First Department matter involving an attorney who had been disbarred in Georgia, New York also imposed disbarment through the reciprocal discipline process.

The available defenses are narrow and can include lack of notice or due process, insufficient proof of misconduct in the original proceeding, or a showing that the conduct disciplined elsewhere would not constitute attorney misconduct in New York.
