Most long-term disability claimants never see the surveillance. They only notice the signs.

In our latest video, partner Michail Hack explains three red flags that may mean your insurer is looking for a reason to deny your claim:

1. A strange car parked down the block day after day could be a private investigator recording you. If you see it, call your local police.
2. Repeated calls and hang-ups often mean an investigator is checking that you're home before setting up surveillance.
3. A sudden new claims representative who's "just getting up to speed" can signal a fresh push to deny. Insurers, like casinos, change the dealer when you're winning.

None of these signs mean you've done anything wrong. They do mean it's time to pay closer attention and protect your claim.

Is it normal for insurance companies to push back on claims?

Yes. In fact, it's a common part of the claims process.

Even when coverage is confirmed, insurers may question repair costs, challenge damage estimates, or dispute the amount they're willing to pay.

Whether you're dealing with an auto, homeowners, or business insurance claim, some negotiation is to be expected.

The bottom line? Pushback doesn't necessarily mean your claim will be denied. Understanding your coverage, documenting your losses, and knowing when to seek professional guidance can make all the difference.

Construction defect cases rarely start as legal problems. They start as decisions: a contractor cutting corners, a design professional missing a detail, a material that doesn't perform as specified.

By the time litigation begins, you're often dealing with multiple parties, competing theories of liability, and a technical record that most attorneys aren't equipped to navigate.

That's what makes these cases hard: the law and the construction have to be understood together. Knowing which party owed a duty of care matters. So does knowing how a building is actually supposed to be built.

A few things that shape outcomes in disputes:

- Early authority involvement is critical. The factual and technical record built at the start often determines what's possible later.
- Multi-party disputes require a clear allocation strategy from day one, not an afterthought.
- The line between a negligence claim and a warranty claim isn't always obvious, and which theory you pursue can affect your recovery significantly.

If you're navigating a construction defect dispute on either side, our blog breaks down what the litigation process actually looks like: https://schlawpc.com/construction-defect-negligent-construction-litigation-support/

That "check-in" call from your disability insurer may not be a courtesy.

In our latest video, partner Michail Hack explains why long-term disability claimants should treat an interview request with caution.

- Early in a claim, these interviews are routine background checks.
- A year and a half or two years in, an unexpected request often means your insurer is looking for a way to deny your claim.
- Standard questions may hide a few "gotcha" questions aimed at undermining your claim.

Before you agree to any interview, call an attorney. The right preparation helps you understand what the insurer is targeting, so you can respond with confidence.

We are proud to share a significant win for our client and team.

Schwartz, Conroy & Hack, PC Partner Michail Hack secured a major victory for a long-term disability claimant in the U.S. District Court for the Southern District of New York, under one of the harshest legal standards in American civil litigation.

After combing through a 2,600-page claim file, Michail exposed how Matrix Absence Management, Inc. cherry-picked records, ignored five of her treating providers (including her spine specialist), and mischaracterized the evidence it did review. The Court agreed, denied the defendants' motion, and remanded the case for full reconsideration.

Even under standards that heavily favor insurers, a thorough review of the record can expose an unfair denial.

Insurers don't just pay . They look for reasons to deny them.

After a major storm, insurers rely on complex exclusions, tight deadlines, and cumbersome claims processes to limit what they pay. Here's what business owners should know before filing:

- Check your hurricane deductible. Many policies set it at 1% to 5% of your property's total value. On a $1 million property, a 5% deductible means you cover the first $50,000 in losses.
- Meet every deadline. The windows for notice and your sworn proof of loss are short. One missed date can give your insurer grounds to deny or limit a valid claim.
- Expect disputes over cause and cost. Property policies typically cover wind and wind-driven rain but exclude flood and storm surge. Insurers often blame water rather than wind and challenge your repair estimates.

A thorough, well-documented claim submitted on time is your strongest protection.

Your cyber insurance policy may not cover the fraud most likely to hit your business.

Social engineering fraud accounts for 16% of all breaches, according to Verizon's 2026 Data Breach Investigations Report. Yet many cyber policies exclude it.

Here's how the fraud works: criminals trick an employee into disclosing a password, changing a vendor's bank account, or authorizing a wire transfer. The request looks legitimate, and the money is often gone before anyone notices.

The coverage gap is what surprises business owners most:

Social engineering fraud is frequently excluded and must be purchased as a separate coverage enhancement.
Sub-limits can be steep. A $5 million policy may cap this loss at just $100,000.
Coverage often carries risk-control requirements, like dual authorization for transfers and independent verification of payment changes.

Miss those conditions, and a valid claim can be denied.

Don't assume you're protected. Review your policy before a loss forces the question.
