What must the prosecution prove in a fourth-degree stalking case?

Under New York Penal Law § 120.45, it is not enough to show that contact happened. Prosecutors must prove an intentional course of conduct directed at a specific person, that the conduct served no legitimate purpose, and that the accused knew or reasonably should have known it was likely to cause a particular kind of fear or harm. Certain subdivisions also require proof that the accused was clearly told to stop and continued anyway.

NBC New York covered the arraignment of a Bay Shore High School art teacher in Suffolk County First District Court and spoke with KCS Law attorney Karl C. Seman, who represents him.

Seman disputes how the incident has been characterized, telling reporters the allegation amounts to his client being in a public place, parking his car, and trying to have a conversation with someone he knew.

A not guilty plea at arraignment is the beginning of a criminal case, not the end of one. Every person charged with a crime in New York is presumed innocent unless and until the prosecution proves guilt beyond a reasonable doubt.
