One of the most painful calls we receive is the one where someone says, "I think I waited too long." Sometimes they did not, and we can still help. But sometimes, they did — and a case that would have changed their family's life financially cannot be filed because a legal deadline passed.

The statute of limitations is a legal deadline for filing a lawsuit. Miss it, and in most cases your claim is gone forever — regardless of how strong it was, regardless of how clear the negligence was, regardless of how severe your injuries were. The law is unforgiving on this point.

Here is where it gets complicated: the statute of limitations is not the same in every case. It varies by the type of injury, who the defendant is, and a range of other factors. Medical malpractice cases often have shorter windows than general personal injury cases in many jurisdictions. Claims involving government entities often have additional notice requirements with even shorter deadlines — sometimes as short as 30 to 180 days.

There is also a concept called the "discovery rule" that can extend the deadline in some situations — typically when the victim could not reasonably have known about their injury or its cause right away. A misdiagnosis case, for example, might use the discovery rule to start the clock from when the patient learned of the error rather than when it happened. But these exceptions are not automatic, and courts apply them narrowly.

Waiting to consult an attorney also allows evidence to disappear. Surveillance footage gets overwritten. Witnesses become harder to locate. Records that could have been preserved are lost.
