It's a process 💕

One of the greatest privileges of my work is the moment a baby is placed into the arms of my clients. I understand the overwhelming joy, relief, love, and excitement that fills the room when consents are signed. It is emotional and life-changing.

🩷It is also important to remember — this is still a legal process.

💙At that point, you are the baby’s guardian, not yet the legal parent.

🩷Under NY law, birth parent(s) have 45 days to file a revocation. There are still important steps ahead: updated clearances, post-placement reports, and ultimately, adoption finalization — the day you officially become legal mom or legal dad.

🩷Yes, you already love this beautiful baby with your whole heart. Yes, they already feel like yours in every way that matters emotionally. But adoption is a process, and protecting that process is part of protecting your family.

Post Adoption. Private Adoption.
A Post Adoption Contact Agreement ("PACA") is an agreement between the biological parent(s) and the adoptive parents for ongoing contact. It is VOLUNTARILY agreed upon and should always remain child focused.

What does it include? A little (photos/updates periodically) ---> A lot! (visits/holidays). And everything in between.

Is it enforceable? Yes? No? Yes. It can be enforceable in NY if it filed at the time of the adoption and the judge issues an Order incorporating this Agreement if the Judge believes it is in the best interests of the child.

What if the Judge won't sign it? If the birth parent can prove within the 45 day window after signing a consent (out of Court) that she relied on this PACA, then the Court may place it down for a hearing to determine if she relied on this agreement in consenting to the adoption. (Rarely, will a Judge make a decision on PACA within 45 days post filing of adoption petition).

What if the Judge sign its, and it is not complied with? Then ... the biological parent can file for enforcement in the Court that issued the Order of Adoption. The Court may appoint an Attorney for the Child and will most likely conference the case to see why it hasn't been complied with.

The adoptive parents have the right to parent their child and make decisions to ensure their well-being. If the parent states that they don't believe it is "safe" to continue contact then the Court will most likely permit the visits/contact to cease. However, if they just "don't want them" or "too busy", then the court could direct the parents to comply.

Adoption Tax Credit.
If you’re considering adoption—or have recently finalized—there’s good news: the adoption tax credit continues to be one of the most meaningful ways the federal government helps families offset the cost of adoption.

ADOPTION TAX CREDIT: In the year of finalization...

💰 How much is the adoption tax credit?

2026 adoptions: up to $17,670 per child

2025 adoptions: up to $17,280 per child

The credit is calculated per child, so families who adopt more than one child can claim the credit for each adoption.

🔄 Now partially refundable

For the first time in years, the adoption tax credit is partially refundable. That means families with lower tax liability may still receive:

Up to $5,000 via a refund check for 2025 adoptions

Up to $5,120 via a refund check for 2026 adoptions
