When dividing real estate, a formal appraisal by an expert is required, and if significant time passes before the case resolves, an updated appraisal will be needed since valuations change.

The net equity is calculated by subtracting the mortgage from the appraised value, and if one party is being bought out, their name must also be removed from the mortgage through either a payoff or a refinance.

Retirement assets are divided in a New York divorce by what is called a non-taxable event.

Either the retirement account has to be rolled over to another retirement account, or some retirement plans require a Qualified Domestic Relations Order so the funds transfer from one party to another without triggering taxes.

The non-titled spouse is entitled to 50% of the retirement funds accumulated during the marriage, calculated based on how many years the marriage overlapped with years worked at that job.

For example, if you were married for 12 years and worked at the same job for those 12 years, your spouse would be entitled to six years' worth of that pension. Anything accumulated before the marriage or after the divorce action starts is your separate property.

Modifying maintenance in New York is much harder than modifying child support. You can't unilaterally reduce payments because your income dropped, you need to prove a significant and substantial change in circumstances and show documented efforts to address it.
