❓ Ask a Lawyer: We Found a Will After Our Loved One Passed Away. What Do We Do?

Question: “My loved one passed away, and we didn't know there was a will. We found one while cleaning out the house. What do we do now?”

Answer: First, make sure the will was validly executed—meaning it meets the witness and other legal requirements under Georgia law.

Once you have the original will, the person named as the executor (or personal representative) in the will would generally submit it for probate in the county where your loved one resided. This is done by filing a petition to probate with the local Probate Court.

In most circumstances, an attorney assisting with the probate process can prepare the petition and help the executor navigate the filing, notice, and publication requirements.

Finding a will is only the first step. Knowing what to do with it is just as important. If you've found a will after a loved one's passing, getting legal guidance early can help.
