Failing to plan for the incapacity or death of an owner or key employee can destroy a business. Life insurance proceeds and savings can provide financial stability but will not address the basic issues of who will be able to take charge and run the show. Simple tasks like signing paychecks may become impossible if the only person authorized to act becomes incompetent or passes away.

Thankfully, many of these issues can be addressed through basic estate planning. Executing a Durable Power of Attorney will ensure there is someone authorized to make legal and financial decisions in the event the business owner loses capacity. Similarly, a Last Will and Testament or Revocable Trust can spell out who will run the business after death, who will inherit the business (or to whom the business may be sold), and even lay out steps to be taken in the event of the owner's death.

As with any kind of planning, being proactive greatly reduces the headache, stress, and costs associated with the death or incapacity of a business owner. The following article does a nice job of laying out some of the issues arising from the failure to plan.
