Before signing a Judgment in a California divorce, here are some key points a party should understand and confirm:

Finality of the Judgement: The Judgment is legally binding and difficult to change once entered. It will control your rights and obligations going forward, so it’s critical to fully understand and agree with all terms.

Division of Property and Debts: Ensure all assets and liabilities are fully disclosed and properly divided and division is equal or otherwise agreed upon. This includes real property, bank accounts, retirement accounts and investments. Credit cards, loans, and other debts.

Support Obligations: For spousal support (alimony) you want to know the amount, duration and whether the support can be modified. In a California divorce, the family residence is often one of the biggest issues because it’s usually a major asset and tied to both finances and custody. Here are some options, framed the way courts and practitioners typically look at them:

Sell the home and divide the proceeds: Most straight forward option, house sold, the mortgage and costs are paid off and remaining equity split.

One spouse buys out the other: One party keeps the home and buys out the other’ share of the equity, which can be done by refinancing the mortgage, offsetting with other assets.

Temporary exclusive use (during the case): While the divorce is pending, the court can award one spouse exclusive use and possession of the home even before the final division. This is common in cases involving children or conflict.
