California requires all drivers to notify the DMV within ten days of an accident if the accident caused more than $1,000 in damage or caused any injuries. It does not matter who was at fault for the accident. The form is titled SR-1 and can be found on the DMV website, or can be filled out by your attorney.

California is close to passing a new law that will require cars sold in 2030 to provide an audiovisual alert when the driver exceeds 10 miles per hour over the posted speed limit.

We will find out by September 30 if the law is passed.

Your auto insurance can provide coverage for you if you are hurt by another vehicle, even if you aren’t driving. If you are riding a bike, crossing the street or even a passenger in someone else’s car, and you are hit by a car, your under-insured auto insurance can provide coverage for your injuries.

For most personal injury cases you have two years from the date of your injury to file a lawsuit. This is called the statute of limitations and in California if you are hurt in a car accident, slip and fall or dog bite, you usually have two years to resolve the case before you must file a lawsuit. When we file a claim against an insurance company, we regularly tell our clients to change their social media accounts to private. This is because auto insurance companies will search your social media posts or even create a fake profile to follow you in order to screenshot all of your posts. They will take ordinary posts and try to use them as evidence to claim that you are not injured or the injury has not affected your daily life. We know this is not true, but it is best practice to keep these posts out of their hands by changing all of your accounts to private.
