Public Service Announcement:

Evictions CAN be filed currently. However, under the latest Emergency Covid Order issued by the Texas Supreme Court, the tenant WILL be informed of potential rental assistance programs. If available and the tenant wishes to participate, your case WILL be delayed to allow participation in those programs. So, it is better to inform your tenants BEFORE you file. It may end up getting money to landlords and save tenants from eviction - for now.

PSA: Those Will-making programs online and sold in stores make more money for a lawyer than drafting a Will. So, probate lawyers don't mind if you go that direction, we just don't advise it. Laws are very specific about how a valid Will is made. You don't have believe me. The truth eventually reveals itself and it costs about three times as much.

I went to the Fort Bend Lunch and Learn today because it was a free CLE hour and it sounded quite interesting. It was mind-blowing!!! All attorneys should check this out and request your county to be fully integrated into the system.

A lawyer can - not only - draft a valid Will that makes probate seamless, but also can assist in making your estate pass immediately to family and friends without the need for probate. The internet can't do that!

As unpleasant as it is to think of our own demise, it will happen one day. If you just can not bring yourself to get a lawyer drafted Will, then be sure to handwrite your own Will - yes, entirely handwritten. Do not forget to name the person who gets your "residuary estate" and please, please, PLEASE name a person you trust as "Independent Executor" to "serve without bond". Yes, these few words are very, very important words. I have seen internet and self-drafted Wills cost much time and money when the family is still grieving. I promise, it really does save money and heartache to have a professionally drafted Will.
