For those awaiting pending advance parole applications or considering applying for advance parole, today the Board of Immigration Appeals overruled their 2012 precedent about whether advance parole travel is a departure that triggers the unlawful presence bars under the Immigration and Nationality Act. New advance parole travel will now trigger those bars! Fortunately, the decision is not retroactive. However, this means that those awaiting advance parole decisions or considering filing need to consult an immigration attorney about their legal options. Those who already completed their advance parole travel but have not yet adjusted status hopefully will still be able to adjust their status based on the legal precedent in place at the time of their previous advance parole travel. Nonetheless, it is strongly recommended that they also consult an immigration attorney prior to filing for adjustment of status.

Effective September 15, 2026, DHS will no longer issue F student or J trainee visas valid for duration of status. Undergraduate student visas will be capped at 4 years, and those needing more time must apply for and receive an extension of their stay. The grace period to depart or change status also will decrease from 60 to 30 days.
International students and their family members currently in the U.S. on F or J duration of status visas, particularly those already here 4 years or longer, are encouraged to consult with their foreign student advisors, and/or with immigration attorneys about their options and how these new rule changes will affect them.

International students could once stay as long as they needed to complete their college degrees, but that's changing, and the restrictions could cut into college budgets.

Travel Warning!
I am continuing to hear widespread reports of detentions at U.S. domestic airports the past few weeks. These detentions include asylum applicants with valid work permits and lawful permanent residents with even minor criminal history, including charges only. Unfortunately, anyone who is not a U.S. citizen or a lawful permanent resident completely lacking any arrests or criminal history needs to consult an experienced immigration attorney before ANY travel, even domestically, right now. Even if you have a valid work permit or resident card and you've safely traveled domestically many times before, you may be at risk of detention at this time. Please be aware and be careful!

WARNING TO CARRY YOUR DOCUMENTS! A federal court has overturned a lower court order preventing the Trump administration from expanding expedited removal (rapid deportation without a court hearing) nationwide and to all persons who cannot prove they have been in the U.S. for at least two years. All persons anywhere in the United States may be stopped and asked to provide evidence of their immigration status or proof that they have been in the United States for more than two years. Make certain you have this evidence with you at all times.

I realize people are afraid of losing their work permits or resident cards, but carrying a copy is NOT sufficient. Make some copies to keep at home in case it is necessary to replace a lost document, but you must carry your original immigration document(s) with you.

We are disappointed by the Supreme Court's decision allowing the Trump administration to end TPS for Haiti and Syria in spite of ongoing violence and instability in both countries. TPS already has ended for several other countries, and this decision likely will result in the administration seeking to end TPS for additional countries as well. Those with TPS are strongly urged to consult with experienced immigration attorneys about their options.
