If you have a criminal record and are going through a custody dispute, you need to know how Virginia courts may view it.

Judges look at a parent's full history, including criminal convictions, when deciding what's in the best interest of the child. The impact depends on:

- The nature of the offense (violence vs. non-violent)
- How recent the conviction is
- Whether children were involved or present
- Steps taken since the conviction (counseling, sobriety, etc.)

A record doesn't automatically disqualify you from custody. The right legal strategy matters enormously.

Strentz Greene & Coleman handles both family law and criminal defense; we understand exactly how these cases intersect. Let us help. Call us at 540-479-1511.

Practical tip for anyone going through a divorce or separation: get your finances separated as soon as possible.

Here's what to do now:

- Open a personal checking and savings account in your name only
- Apply for a credit card in your name to start building individual credit
- Redirect your direct deposit to your new account
- Keep records of any joint account activity

You're not doing anything wrong by protecting yourself; this is smart, standard practice during separation. Virginia courts will look at financial records, and having clean, separate accounts helps your case.

Need help understanding the financial side of divorce? Our team at Strentz Greene & Coleman has guided hundreds of Virginians through it. Call us at 540-479-1511.

Many people are shocked to learn this during divorce proceedings: the retirement account you've been building for decades is considered marital property in Virginia.

This applies to:

- 401(k) and 403(b) plans
- Pensions and defined benefit plans
- IRAs (contributions made during the marriage)
- Military and government retirement benefits

Dividing retirement accounts requires a special court order called a QDRO (Qualified Domestic Relations Order). Without it, you can't actually access those funds, and if you miss it, you may lose that asset permanently.

This is one of the most overlooked and most valuable parts of a divorce settlement. Make sure you have an attorney who knows what they're doing. Need legal assistance with your divorce? Call us at 540-479-1511.

Let's bust one of the most persistent myths in family law.

MYTH: Mothers automatically get custody.
FACT: Virginia law explicitly prohibits courts from giving preference based on gender.

Fathers have the same legal standing as mothers when it comes to custody. Courts focus entirely on the child's best interests, which means a father who is the more involved, more stable parent can and does win primary custody.

What actually matters:
- Day-to-day involvement in the child's life
- Stability of home environment
- Willingness to support the child's relationship with the other parent
- The child's needs and established routine

If you're a father navigating a custody case, don't assume the outcome before it's decided. We fight for fathers every day. Call us at 540-479-1511.

Can a grandparent fight for the right to see their grandchild in Virginia?

Yes, and many do. Virginia law allows grandparents to petition the court for visitation rights. The court will consider:

- The nature and history of the relationship between grandparent and child
- The child's age, health, and emotional needs
- The wishes of the child's parents
- What arrangement serves the child's best interests

This is a nuanced area of family law. If you're a grandparent seeking access to your grandchildren or a parent navigating a grandparent's petition, we can help. Call us at 540-479-1511.
