Good news for those considering bankruptcy during these difficult times. The funds which may be received in the amount of $1,200.00 for an individual ro $2,400.00 for a married couple are not being considered "income" for purposes of calculating average monthly income for the 6 months preceding filing (the "means test"). Further, the US Trustee's Office has indicated that in Chapter 7 liquidation cases it appears unlikely that trustees will seek to confiscate those funds if received just before or while in bankruptcy as the amount is relatively small.. Further, any attempt to pursue those funds by a trustee must first be approved by the US Trustee office (a division of the Dept of Justice) which again appears unlikely.
