A renewed public service announcement:
1) Don't consume alcohol and then choose to drive.
2) If a trooper pulls you over and smells alcohol, you are almost certainly going to be arrested for driving while impaired.
3) You will not be able to talk yourself out of an arrest.
4) Be polite.
5) If asked "how much have you had to drink tonight, consider answering: "I don't answer those questions without my attorney."
6) The trooper CAN have you produce your drivers license, registration, and proof of insurance.
7) The trooper CAN have you step out of your vehicle.
8) There is NO PENALTY for not performing field sobriety tests. Those typically are the roadside blow, the HGN (follow my finger with your eyes and your eyes only) the one-legged stand, and the walk and turn. You CANNOT pass those tests.
9) By performing these tests you are ONLY giving evidence against yourself.
10) Do not volunteer to perform these tests. Consider saying, "I don't perform those tests."
11) There is only a penalty, after being arrested, if you refuse to blow into the intoximeter at the sheriff's office. That punishment is a one year suspension of your drivers license.
12) Don't consume alcohol and then choose to drive.
