💰 $280,007.00 SETTLEMENT.
Bodily injury limits. UIM limits. Every dollar that existed.
🚶 My client was a pedestrian. He was at the scene of a crash that had already happened — doing exactly what he was supposed to be doing.
A distracted driver never saw him.
🚫 That driver wasn't wearing a seat belt. Neither was the female passenger beside him. There were open containers in the car. The vehicle was poorly maintained. And the physical evidence inside that cabin told us exactly where his attention was in the seconds before impact. It was not on the road.
Progressive had all of it. Before suit. Before a single deposition.
❌ Their denial rested on a crash report that placed my client inside a vehicle. He was never in one. Not a typo. Not a clerical error. Just plainly wrong. Witnesses confirmed he was a pedestrian. Progressive didn't care.
🔍 When we asked to inspect the vehicle, they told us that because they had denied liability, they didn't have to give us that opportunity. They were wrong about that too. And that inspection showed us the truth about what that driver was really doing seconds before he nearly killed my client.

That is not a hard case. That is poor handling, and it's a disservice — to my client, and to their own insured, who they left exposed while they fought a battle they were never going to win.
I once believed insurance companies existed to protect people when they mess up. This one put its own policyholder at risk rather than look honestly at what was in front of them.
⚖️ It settled in litigation. It never should have gotten there.
🙏 I'm proud my client trusted me with this. He suffered real, life-changing injuries, and I wish the number could have been bigger, because he deserves more than the policies allowed. What I can tell him is that we went after every dollar available to him — and we recovered all of it.
