Nuestra oficina entiende su preocupación por las largas demoras en el procesamiento de la solicitud de perdón I-601A que hemos presentado en su nombre ante los servicios de ciudadanía e inmigración. El Centro de Servicio de Nebraska actualmente tiene un promedio de 34 meses para resolver estos casos, y el Centro de Servicio de Potomac actualmente tiene un promedio de 39.5 meses para resolver estos casos a partir de enero de 2023. I-601A Waivers Breaking News

Our office understands your concern about the long delays in processing the I-601A waiver application.

While the lengthy processing delays for the I-601A Waiver Applications are frustrating, we are still receiving high approval rates.

The Nebraska Service Center is currently averaging 24-34 months for these cases, and the Potomac Service Center is currently averaging 39.5 months for these cases as of January 2023.

The failure to adjudicate these cases in a timely manner has frustrated thousands of applicants across the US from completing their green card process and from being able to live and work legally in the United States.

Rest assured the cases are still moving forward and this process remains a very worthwhile process to pursue. The good news is that our approvals are as high as they ever were.

Also more good news has recently come in the form of a class action lawsuit filed against USCIS on January 23, 2023. The goal of the lawsuit is for the Court to compel faster adjudication of the I-601A Waiver.

Our office is also offering to file an individual lawsuit against USCIS for a reasonable fee. The lawsuit is called a writ of mandamus and it compels the government to adjudicate the case.

The Department of Homeland Security has established a procedure for nationals of Venezuela, Haiti, Nicaragua, and Cuba to enter the United States with or without their immediate relatives in an orderly manner. To be able to benefit from this program you must be outside the United States. This temporary permit will allow an individual to enter the United States for a 2-year period for urgent humanitarian reasons or significant public benefit.

To be able to apply for this benefit you must fulfill the following requirements:

- Have a financial supporter in the United States for the duration of their parole in the United States;
- Undergo and clear a robust security vetting;
- Meet other eligibility criteria; and
- Warrant a favorable exercise of discretion.

TPS Extension for Venezuela

Secretary Mayorkas has announced the extension of temporary protected status for Venezuela. The 18-month extension of TPS for Venezuela will be effective from September 10, 2022, through March 10, 2024. Beneficiaries under Venezuela’s existing designation, and who were already residing in the United States as of March 8, 2021, are eligible to re-register for TPS under this extension. Venezuelans who are currently eligible for TPS under the existing designation but may have not yet applied with U.S. Citizenship and Immigration Services (USCIS) should file their applications prior to the September 9, 2022, application deadline. Breaking News for TPS Holders!

USCIS will be creating a new travel authorization document for TPS holders that may be used to qualify for adjustment of status, along with a qualifying family petition. Once a TPS holder travels with this new authorization document, they may be “inspected and admitted” for purposes of qualifying for adjustment of status even if they initially entered without inspection.

Additionally, TPS holders who traveled on advance parole prior to this announcement may still be able to use their advance parole entry to qualify for adjustment of status.

Breaking news!

Individuals who have been present in the United States without authorization for a period of 6 months or more, eventually left the United States and entered again with a valid non-immigrant visa could benefit from a new policy change. Under the new policy, the 3- or 10-year bar can be met inside the United States. This is a great development because prior to the policy change most persons would require a waiver in order to adjust their status inside the United States. Under the new policy, as long as the person has waited 3 or 10 years inside the US, they will be eligible to adjust status without the need to file for a waiver.

A Texas federal Judge ruled on July 16, 2021, that the Deferred Action for Childhood Arrivals commonly known as DACA was improperly established. This current decision prevents U.S. Citizenship and Immigration Services from granting DACA applications. The DACA program has been challenged numerous times in the past and it has prevailed. Therefore, we must wait for the Department of Justice to appeal the decision and proceed accordingly. Do not lose hope in the program as the current administration will strive to make sure dreamers are protected. USCIS has communicated that they will continue to accept DACA applications while the case is being litigated. Due to inclement weather, USCIS has announced that the Dallas Field Office and many of the Application Support Centers where biometrics are taken will be closed on February 16th and February 17th.
