As the cost of living in the U.S. continues to climb, foreclosures are also on the rise.

May foreclosure-related filings, which include default notices, scheduled auctions and bank repossessions, were up 7% from April and up 14% from a year ago, to 35,196 properties, according to the real estate data group ATTOM.

Lenders began the foreclosure process on 23,245 properties in May, up 4% from last month and up 5% from a year ago. States with the most foreclosure starts in May included Florida, where 2,901 foreclosures got underway, followed by California, with 2,451 foreclosures started, and Texas, where 2,286 properties fell into the foreclosure column. Bankruptcy may help relieve your debt obligations, but it will impact your credit for years.
Bankruptcy is a special legal proceeding you can use to reorganize or get rid of your debt, depending on your financial situation. Bankruptcy can be helpful if you’re overwhelmed with financial commitments, but it could also negatively affect your credit. A bankruptcy will generally stay on your reports for up to 10 years from the date you file.

“I refer to bankruptcy as kind of Armageddon on someone’s [credit],” says Freddie Huynh, vice president of data optimization for Freedom Debt Relief.

The good news is your credit can gradually heal if you take the right steps. Here’s what can happen to your credit reports when you file for bankruptcy.
Credit recovery post-bankruptcy
After filing bankruptcy, you can work to build your credit again — but it won’t be instantaneous.

“It’s a marathon, not a sprint,” says Huynh.

Start by making a list of the debts included in your bankruptcy, and check them on your credit reports. After they’re discharged, it may take about two months for the accounts to be updated on your reports. They should be labeled “included in bankruptcy”, “discharged” or similar language.

Check your reports every few months for errors. Make sure to check that the negative marks are removed in a timely fashion.

In the meantime, consider building credit with a secured credit card. Only take out lines of credit you can afford, and pay back debt as agreed. After several years’ worth of responsible credit behavior, your credit scores can improve.

“If someone walks the straight and narrow after bankruptcy,” Huynh says, “it would be possible their scores would be higher now than prior to the bankruptcy.”

Bottom line
For many, bankruptcy is a last resort. If you’re considering filing, know the financial and credit implications.

Your credit will show a public record of bankruptcy for up to 10 years, and discharged accounts will get a negative mark. You can lessen the effects on your credit by taking extra care when using credit going forward and by making sure your credit reports accurately reflect your situation.

If you are currently in a mortgage forbearance program temporary helping you during a financial setback due to COVID-19, it is important to take a look at the type of mortgage loan you have and the date your agreement becomes due. If you are a homeowner who experienced a financial hardship during the pandemic and your temporary relief plan is coming to an end, this information will help you to know the options.

Data shows approximately four million U.S. homes went into forbearance in 2021. The number of forbearances has dropped around one million in 2022 according to RealtyTrac. There is a projection that another quarter of a million forbearances are to expire in 2022.

The payments missed under a forbearance plan are not forgiven, so you must be prepared to resume payments. Be aware the plan will include the regular mortgage monthly payments plus the balance accumulated during the forbearance period. Some of the options available for repayment once the forbearance term expires are:

Reinstatement — a one-time lump sum of any missed payments. After the reinstatement, regular payments of the mortgage continue under the original terms of the loan. Ask yourself, if it’s possible to pay back all the missed payments at once? If the answer is ‘no’, the mortgage servicer will offer other options if you can’t pay the full amount.

Repayment plan — you will repay the missed amount over a set amount of months, typically 3-12 months, on top of your regular monthly mortgage payments until the balance of the missed payments is paid off.

Deferred payments — To bring the loan to current status, the deferred amount is due along with the last mortgage payment date or earlier if you sell your home, refinance it, or pay off your loan.

Extend the amortization period — the length of your loan term increases to pay off the missed amount by extending the original loan term, adding additional mortgage payments.

Loan modification — changing your mortgage loan terms, usually includes a lower interest rate and extend the length of the loan to help reduce the monthly payment.
