Judges look at history.
Not what a parent intends to do moving forward, but what each parent has actually been doing. Who handles bedtime. Who makes the meals. Who knows the pediatrician's name, keeps track of the homework, drives to practice, and gets up at night when a child is sick.

Promises about the future are easy to make, and a judge has no way to test them. A track record is different. It is observable, and it tells the court something reliable about how a household has run.

Judges decide cases on evidence, not labels.

I hear certain words often: Narcissist. Selfish. Manipulative. Sometimes they truly do describe the situation well.

But a judge hears those same words in nearly every contested case that comes before them. They have no way to weigh that label, and they will not try. What a judge CAN do is weigh conduct.

So be specific.

Not "he is controlling," but what he actually did, when he did it, and how often he did it.

Dates. Patterns. Documentation. The things a judge can look at and evaluate.

Many people assume the judge begins forming impressions when testimony starts. In reality, the evaluation begins the moment you walk into the courtroom.

Judges notice behavior. Laughing at the wrong moment, visible reactions to what the other side says, clothing that does not fit the seriousness of the setting. None of it is evidence, but all of it shapes how you are perceived.

The worst offender is the look exchanged between former spouses across the courtroom. Judges see it, and it rarely helps either side.

One husband decided to track his wife's movements. He activated the device but never managed to get it onto her vehicle. She already knew it existed. So while he was sitting with her talking about repairing the marriage, she was watching his location. And where was he?

Parked outside a strip club.

Under Texas law, placing a tracking device on a vehicle you do not own, without the other person's consent, is a criminal offense. It is also the kind of conduct that tends to surface in a courtroom at the worst possible moment.

The better use of your attention is your own privacy. Passwords, location sharing, cloud backups, shared accounts. Handle those early.

Judges pay close attention to how a witness answers, not just what the witness says. When someone takes the stand determined to make their case, doing things like: volunteering information, steering every answer back to their side of the story, and more, the judge notices. And judges can draw conclusions from it.

The better approach is narrower than most people expect. Listen to the question. Answer that question. Stop. If the answer is yes, say yes. If you do not know, say you do not know. If they say state your name, simply state your name.

Advocacy is your attorney's job. That is what the preparation, the exhibits, and the argument are for. A witness who tries to do both jobs at once usually undermines the one they were there to do, and it can cost them.

The most difficult thing to hear from a new client is that they wish they had called sooner. By then, the settlement is signed and the options are limited.

A property settlement that looks like an even trade on paper often isn't. One client believed she was making a straightforward exchange. The difference, once the numbers were understood, was more than three and a half million dollars.

Preparation before you settle is what protects you. Understanding what you own, what it is actually worth, and what the agreement will mean five years from now is not something to work out after the papers are signed.
