A traffic stop does not automatically give the police the right to search your vehicle.
If an officer asks, "do you mind if I search your vehicle?" you are allowed to say no.
A simple response is:

You do not have to argue. You do not have to explain. And you do not have to prove that you have nothing to hide.
Police may still have legal grounds to search in some situations, including when they have probable cause or another recognized legal basis. But if they are asking for your permission, remember this: ๐œ๐จ๐ง๐ฌ๐ž๐ง๐ญ ๐ข๐ฌ ๐š ๐œ๐ก๐จ๐ข๐œ๐ž.
If an officer searches your vehicle anyway, do not physically interfere. Make your lack of consent clear, remain calm, and let the legality of the search be challenged later in court.

A Louisiana man named Warren Demesme was being questioned by police. During the interrogation, he said:

But police kept questioning him, and he eventually made incriminating statements.

His lawyers later argued that the questioning should have stopped when he asked for an attorney. The case reached the Louisiana Supreme Court, where a justice described his words as an โ€œ๐š๐ฆ๐›๐ข๐ ๐ฎ๐จ๐ฎ๐ฌ ๐š๐ง๐ ๐ž๐ช๐ฎ๐ข๐ฏ๐จ๐œ๐š๐ฅโ€ reference to a lawyer. In other words, the court found enough uncertainty in the way he asked to allow the confession to stand.

I have always viewed that as a court getting very creative with language to avoid throwing out a confession.

But here is the lesson for everyone else:

If an officer asks permission to search your car, the officer may be trying to obtain your consent because consent eliminates the need to establish probable cause. Do not help build a case against yourself.
Never argue, interfere, or physically resist. Stay calm, keep your hands visible, and ask:

If the answer is yes, leave calmly. If the answer is no, remain silent and ask for a lawyer.
Innocent people get charged because they talk too much, guess at answers, make innocent mistakes, or consent to searches believing they have nothing to hide.

๐Ÿšจ **Texas THC Laws Have Changed โ€“ Here's What You Need to Know** ๐Ÿšจ

As of **July 31, 2026**, Texas has significantly changed how many h**p-derived THC products are treated under state law.

Here's the short version:

โŒ **Products containing Delta-8 THC, Delta-10 THC, THCP, and many other intoxicating h**p-derived THC cannabinoids are now considered controlled substances in Texas.**

โœ… **C*D products that do not contain prohibited forms of THC may still be legal.**

โœ… **Certain h**p products containing no more than 0.3% Delta-9 THC (by dry weight) may still be lawful, depending on the product and compliance with Texas regulations.**

โš ๏ธ **Possession of products that were commonly sold in v**e shops, smoke shops, gas stations, and C*D stores just days ago could now result in criminal charges.**

Many Texans purchased these products believing they were completely legal. Unfortunately, the law has changed, and what was once sold over the counter may now expose someone to serious criminal consequences.

Trial preparation matters.



This week, we were in jury selection on a felony evading arrest case. After spending the day working through voir dire, it became clear that a jury was not going to be selected from that panel, and the case was reset.



Our client originally faced three felony charges and one misdemeanor.



Following additional negotiations, the case was resolved with pleas to two misdemeanor offenses with credit for time served, and two felony charges were dismissed.



Every case is different, but one thing remains the same: you cannot effectively negotiate from a position of strength unless you're prepared to try the case. We prepared this case for a jury, and that preparation made a difference.



I also want to recognize Lakesha Smith, who served as second chair throughout jury selection. She put in countless hours preparing for trial, and I appreciate her hard work, professionalism, and dedication to our client.
