Texas has allowed no-fault divorce for more than 50 years. Under current law, either spouse can file for divorce based on "insupportability" - meaning the marriage has broken down due to conflict, with no reasonable expectation of reconciliation - without having to prove wrongdoing by the other party.

That may not always be the case. In 2025, House Bill 3401 proposed eliminating no-fault divorce in Texas entirely, which would have required couples to prove fault - such as adultery, abandonment, or cruelty - to obtain a divorce. The bill failed in committee and did not become law. However, Texas Republicans are already signaling renewed efforts to revisit the issue ahead of the 2027 legislative session.

For anyone currently navigating a divorce or considering one, Texas law has not changed. But it is worth staying informed. MBH Law will continue to monitor developments and keep our clients up to date.
