Good news for the real estate industry out of Austin.
Governor Abbott has signed SB 885, Senator Hughes Quitclaim Bill. The Texas Land Title Association lobbied hard to get this bill passed. In the past if a quitclaim deed appeared in the chain of title, a subsequent purchaser was on notice of a potential claim from an unrecorded matter and could not obtain bona fide purchaser status. As of September 1, 2021 after a quitclaim deed has been properly filed in the public records for four years, a subsequent purchaser or creditor will have good faith protection and will not have to worry about unrecorded claims. IMPORTANT, parties should still avoid using quitclaim deeds to transfer interests in real property. In most cases, a deed without warranty can have the intended benefit that parties associate with quitclaim deeds.

Quit claim deeds create a huge problem when they appear in the chain of title of Texas properties. Title companies have had to make Seller's track down and "fix" these broken links in the title chains, sometimes involving individuals who have been deceased for years.

The Texas legislature is looking at a potential fix for this problem to let a quit claim deed season after it has been recorded for four years. Read more from the Texas Land Title Association.

Tarrant County has followed Governor Abbott's lead and is immediately rescinding the county-wide mask mandate. The City of Fort Worth has decided not to extend their mask mandate. The state mandate will expire next Wednesday March 10th.

Keep in mind that businesses may still require masks of their patrons, and federal mandates are still in place for areas where the federal government has jurisdiction such as federal buildings and air travel.

While the governor’s order ends next Wednesday, Whitley ended his on Tuesday to avoid confusion and misunderstandings.

Property line disputes can be a serious problem between for property owners. One owner's rights may not be exactly what they think they are. When you find yourself in a dispute with your neighbor, consult with an attorney before it gets to this point.
