Velocity Investments was AWOL in court today. Case dismissed. Settlement offer was something ridiculous like 75% if paid in a lump sum. Then they don't bother to come to trial when you push back.

Covered a hearing for another attorney, Portfolio Recovery Associates was AWOL, so the case was dismissed for want of prosecution.

I guarantee you the settlement offer was high.

Don't let these guys bully or guilt you into a settlement.

Just had a trial w Cavalry SPV I. They were claiming to have bought a post repo deficiency debt from Westlake Services LLC. They have to be able to prove that the collateral was disposed of in a commercially reasonable fashion. This is especially diificult when you are in an actual court of record and Cavalry cannot authenticate Westlake's documents.

They sent an appearance attorney who was given all of 2 hours notice of the hearing and he was totally unprepared. They had done the same thing a few weeks ago for the pre-trial.

Don't let these guys guilt or bully you. Seek competent representation and push back.

Had a trial with Bank of America this afternoon. The collection mill representing them has always been a dumpster fire. In 2 years they never made disclosures or filed a business records affidavit. They sent appearance counsel in empty handed.

RESULT: directed verdict for the defense. BoA takes nothing.

Covered a hearing for a friend and beat LVNV Funding in trial because they could not authenticate the original creditor's documents. The damage amount was pretty high and I probably kept this guy out of a bankruptcy.

Last week I obtained a take nothing judgement against Capital One/Discover because, among other things they failed disclose the witness and they couldn't prove up the merger or that this account was part of the merger. Many of these collection firms are high volume mills staffed by brand new attorneys. They are sloppy to say the least. Call me before you let them bully you into giving them a ridicuous settlement.

Beat Portfolio Recovery in trial last week because they couldn't prove up chain of title. Especially sweet because client was a friend. That's $3,000 staying home and it will come of the credit report if PRA knows what is good for them.

Portfolio Recovery is AWOL. Hard to prove your case when you don't show up. That's about $16,000 staying home.

Ally Financial no shows. In a post repossession deficiency lawsuit the creditor must show that the vehicle was disposed of in a commercial fashion. Hard to do when you dont show up for trial.
