I have experience defending consumers from lawsuits on credit card debts brought by the original creditors, and also from companies known as debt buyers or 3rd party creditors. I have also defended consumers who have been sued over the remaining balance after their vehicle has been repossessed. I also assist consumers by helping them to seek the protection of Chapter 7 Bankruptcy. I am a debt relief agency under Federal Law. I help people file for Bankruptcy. I also write simple wills and prepare basic estate plannig documents. I also probate wills.

Had 2 hearings today:
1. Covered for another attorney this AM. Velocity Investment's failed to file any evidence w/in the 14 day deadline, then their attorneys failed to show for trial. Case dismissed for want of prosecution (DWOP) and about $50,000 is not changing hands.

2. This afternoon was a file of mine and Portfolio Recovery failed to file any evidence within this Court's 3 day deadline. Wound up with a take nothing judgment. That's about $7,500 staying home.

Bank of America non-suits at the bench. Client hired me at last minute but they had not timely submitted their evidence to the court. They were sloppy because they were going against an unrepresented party. Case was a year old. The judge was not amused. Money stays home for now.

In a trial on the merits I secured a take nothing judgment against LVNV Funding. Not only were they late in filing their evidence, but there was no business records affidavit attached. That means that the documents don't come in to evidence and they have no evidence. That's a little over $10K staying home.

Covered 2 hearings this morning.

Navy Federals attorneys failed to timely file their evidence. Worse yet the fill in the blank business affidavit was blank. The judge was laughing. Plaintiff takes nothing.

Velocity Investments could not authenticate the original creditor’s documents. Again, Plaintiff takes nothing. The debt was $20,000 and their last offer was 75% in a lump sum. Get real! Who has $15,000 burning a whole in their pocket these days?

Now more than ever you need to push back on the school yard bullies in suits.

Same Day Round 2. Portfolio Recovery's Attorneys failed to timely file their evidence. At trial they asked for a last minute continuance which I objected to and the Court agreed with me. They non-suited at the bench. That's over $34,000 staying home.

Covered a hearing for another attorney. This was Capital One claiming a merger with Discover. Capital One's attorneys waited until the night before trial to submit their evidence to The Court. By law has to be done 14 days in advance. The Judge agreed with me and their evidence stayed out. Capital One non-suited. Client owes nothing.

LVNV Funding non-suits at the bench.

After making a ridiculous settlement offer LVNV blew several deadlines, not to mention had a serious gap in title. Yeah when you are claiming assignment of someone else’s account proving ownership is kind of important.

Couple of other observations from today’s festivities:

Several unrepresented people basically threw themselves at the mercy of the Court. This is not effective in civil court. Either they can prove damages or not. The fact that they may never collect is not The Court’s problem and the The Judge is not going to work out a payment plan for you or reduce their damages. In 2 of the 3 cases the collectors were represented by local appearance counsel who have no authority to negotiate deals

Also the first 2 cases called the local appearance counsels had to dismiss their cases because they were still not ready and The Judge was ready to move his docket. This is part of an ongoing trend Im seeing where the collectors are getting less reasonable while at same time are not ready for trial. The only way to deal with bullies is too push back.

Velocity Investments was AWOL in court today. Case dismissed. Settlement offer was something ridiculous like 75% if paid in a lump sum. Then they don't bother to come to trial when you push back.

Covered a hearing for another attorney, Portfolio Recovery Associates was AWOL, so the case was dismissed for want of prosecution.

I guarantee you the settlement offer was high.

Don't let these guys bully or guilt you into a settlement.
