A DWI case can look straightforward on paper: a traffic stop, field sobriety tests, and maybe a breath or blood result.

But the details matter.

When evaluating a DWI case, some of the questions I look at include:

• Was there a lawful basis for the traffic stop?
• Were the field sobriety tests administered correctly?
• Does the body-camera or dash-camera footage match the officer’s report?
• Was breath-testing equipment properly maintained and operated?
• If blood was drawn, was the sample properly collected and handled?

A number over .08 doesn't eliminate the need to examine how that number was obtained or whether the rest of the evidence supports the government's case.

Most people facing criminal charges are thinking about jail time and fines. Few are thinking about their professional license — but they should be.

In Texas, licensing boards for nurses, teachers, real estate agents, pharmacists, CDL holders, and dozens of other professions require disclosure of criminal charges and convictions. Some boards initiate their own investigations the moment charges are filed — before any court outcome is determined.

A DWI conviction can suspend a commercial driver's license for a year on a first offense and a lifetime on a second. An assault conviction with a family violence finding can disqualify applicants from positions in healthcare, education, and law enforcement. Even a deferred adjudication, which is not technically a conviction, must be disclosed to most licensing boards and can trigger consequences.

Think you know Texas self-defense law? Some of what you've heard is flat-out wrong. ⚖️

MYTH: "Texas is a stand-your-ground state, so you can use force whenever you feel threatened."

FACT: Texas law does remove the duty to retreat in many situations — but force must still be "reasonable and proportional" to the threat. Excessive force can turn a defender into a defendant.

MYTH: "Self-defense only applies to shootings."

FACT: Self-defense applies to any situation where force was used — a fistfight, a shoving match, even a domestic dispute. The question is always whether the level of force was justified.

MYTH: "If someone is on your property, you can do whatever it takes."

FACT: Texas does have the Castle Doctrine — but it has limits. Deadly force is only justified when you reasonably believe it's necessary to prevent certain serious crimes. Being on your property alone isn't enough.

Here's what you need to know:

ASSAULT (no family violence finding):
→ Can result in fines, jail, or probation depending on severity
→ May be eligible for expunction if dismissed
→ Does not automatically restrict gun rights

ASSAULT WITH A FAMILY VIOLENCE FINDING:
→ A second offense becomes a felony — even if the first was a misdemeanor
→ Cannot be expunged, only sealed through non-disclosure
→ Triggers a federal fi****ms ban
→ Protective orders can limit where you live and who you see
→ Can affect custody and divorce proceedings

The "family violence" label isn't limited to spouses. It applies to roommates, dating partners, family members, and anyone in a household.

A first DWI is scary. A second DWI in Texas changes everything. 🚨

Here's how fast the stakes rise:

FIRST DWI (Class B Misdemeanor):
→ Up to 180 days in jail
→ Fines up to $2,000
→ License suspension up to 1 year

SECOND DWI (Class A Misdemeanor):
→ Up to 1 year in jail
→ Fines up to $4,000
→ License suspension up to 2 years
→ Mandatory ignition interlock device

THIRD DWI (Third-Degree Felony):
→ 2 to 10 years in state prison
→ Fines up to $10,000
→ License suspension up to 2 years

And if your BAC was 0.15 or higher on a first offense? Your charge automatically upgrades to a Class A misdemeanor — the same level as a second DWI.
