What I handed the USCIS officer today — and why it mattered.

Post-memo, officers are asking questions we haven’t seen before. Why did you choose to adjust here instead of Consular Processing? What’s stopping you from leaving? These aren’t casual questions. They’re discretionary red flags if you’re not ready for them.

So I started preparing a statement for my clients to hand over on the spot if their case gets flagged for secondary review. Today it came through.

If you have a marriage-based AOS case pending, DM me or call and I’ll send you:

✅ The checklist of questions you need to be able to answer about why you chose AOS over Consular Processing
✅ A guide on what your evidence package should actually include right now

Free. Because preparation shouldn’t be a surprise.

Let’s call SB4 what it actually is.

Texas gave police the power to arrest people they *suspect* entered the country unlawfully. And that word — suspect — is doing a lot of work. Because there’s no document that says “you look undocumented.” There’s just a person making a split-second judgment call based on how someone looks, sounds, or where they’re standing.

Civil rights organizations have argued this in court. This law invites discriminatory enforcement. That’s not an opinion — that’s the legal challenge.

So while the courts keep fighting over it, here’s what YOU can do right now:

📄 Carry copies of your documents — green card, work permit, receipt notices, passport, TPS, asylum paperwork — whatever you have
📞 Memorize one phone number: family or attorney
🏠 Make a family plan now — who has the kids, where are your documents, who do they call
🤐 If stopped: stay calm, don’t give false info, get an attorney on the phone ASAP

And please understand — a pending case does NOT make you untouchable. A receipt notice is not a force field. Every situation is different.

Don’t wait for an emergency to get prepared.

📋 DM us or reach out directly — we’ll send you a document checklist to get your family organized before something happens.

🚨 UPDATE #2: Here’s what USCIS is now specifically asking for post-memo — and what you need to have ready.

Following the new memo, officers aren’t just interviewing you — they’re requesting documentation to back up every answer. We’re seeing requests for:

✅ Travel history documentation
✅ Explanation letters for any gaps or inconsistencies
✅ Evidence of hardship if removal were to occur
✅ Proof of good moral character

This isn’t just a checklist — it’s a credibility test. The goal is to determine whether granting status in the U.S. is a matter of discretion worth exercising.

Don’t go into this guessing what to bring.

📋 Reach out to us and we’ll send you our updated document guide to help you know exactly what to prepare for your AOS case under the new memo.

Questions? We’re here.

Just left a marriage-based AOS interview and the questions have shifted. Officers are now asking directly why you didn’t apply through Consular Processing — and if anything is preventing you from doing so.

Adjustment of Status has always been discretionary. What changed is the level of scrutiny. Eligibility alone is no longer enough. You need to show family ties, hardship, good moral character, and a credible explanation of your immigration history.

If you have an AOS case pending, now is the time to strengthen your evidence — not wing it.

Questions? We’re here.

Immigration courts are now scheduling hearings with 100 or more people at a time, pulling forward cases set for 2027, 2028, even 2029.

According to this piece in NPR, the goal is simple, to issue more deportation orders faster.

The danger is that people are not being notified when their dates change. Miss your hearing, even by accident, and a judge can order your removal in your absence.

If you have a pending court case, check your EOIR account today. Do not assume your date is the same.

The Justice Department is moving up the court hearings for hundreds of immigrants and scheduling them for mass hearings. If they don't show up, they could be ordered deported.

𝗕𝗥𝗘𝗔𝗞𝗜𝗡𝗚 𝗡𝗘𝗪𝗦 𝗧𝗢𝗗𝗔𝗬, 𝗠𝗮𝘆 𝟮𝟮, 𝟮𝟬𝟮𝟲. USCIS announced that people here on temporary visas who want to apply for a green card must now leave the US and apply through their home country's consulate — except in "extraordinary circumstances."

What this means in practice, for many people, leaving triggers a 3 or 10-year bar to reentry. This policy effectively closes a door that has been a standard, legal pathway for decades.

If you or someone you know has a pending green card application or is considering one, do not make any travel decisions before speaking with an immigration attorney.

Our removal defense paralegal Diana Lopez has been fielding calls from people who got a notice asking for more documents — and when we look into it, a notario or legal assistant filed for them.

We understand why people go that route. But if that case gets denied, you can be put into removal proceedings. This is not a small risk, especially right now.

Hardest part of this job is leaving court knowing the outcome could have been different.

Me and my paralegal Diana are just leaving the courthouse  and today was a tough one. Clients who had options, who had family members that could have filed for them, who just waited too long. The I-130 process is taking almost two years right now and judges are not giving more time to wait for them. That window closes fast.

If someone you know is in proceedings and hasn’t talked to an attorney yet, that’s the call to make. Call us or click the link in bio.
