Update on the I-864 form change we posted about last week.

AILA — the American Immigration Lawyers Association — filed a lawsuit against USCIS over the fact that there was no proper notice given before the old form was rejected. Because of that, everyone now has 30 days to submit the correct form. If you filed the old version, you are not automatically rejected. You have time to correct it.

But here is the part of the new form that nobody is talking about and that every sponsor needs to know before they sign it.

The new I-864 includes a provision that allows USCIS to pull your credit report and discuss what is on it with the applicant — your spouse or the person you are sponsoring. That means if you have debt, a credit card, a loan, a balance, anything on your credit file that the other person does not know about, USCIS can disclose it to them during the review process.

Starting August 31, USCIS will only accept the new version of Form I-864 dated 08/24/26. If you submit the old version, it will not be accepted.

The new form also includes a privacy release allowing USCIS to run a credit check on the sponsor. If you have a credit freeze on your file, lift it now or your case could be delayed.

If you are in the middle of an adjustment of status case or sponsoring a family member, check your forms today.

If you or a family member was ever in removal proceedings and received a deportation order — and then years later got a green card through a different application — that immigration court case did not go away.

A deportation order does not disappear because you got a green card. If you try to apply for citizenship with an open removal order, it will be denied. And you are at risk of ICE arresting you at any time.

The same goes for admin closure. A lot of people think admin closure means their case is over. It does not. It means the judge put the case on a non-active docket. DHS can pull that case back into the active docket at any time. If you apply for naturalization with an admin closed case, that application will be denied.

The moment you receive your green card, if you had any prior immigration court case — removal proceedings, a deportation order, an admin closed case — hire an immigration attorney immediately and go back to immigration court to get that case reopened and terminated.

This is one of the most important things you can do to protect your status and your path to citizenship.

The public charge regulation was rescinded. Until USCIS issues new guidance, the standard for evaluating green card applications is uncertain.

If you are eligible to file for your green card through adjustment of status, file before September. What you submit now gets evaluated under the current standard. What comes next is still being written.

Cash assistance like SSI and TANF, adult Medicaid, SNAP — these are the benefits that come up most in the analysis. Your US citizen children being on CHIP or Medicaid is a different question, and your attorney needs to know about it before you file.

The analysis also looks at your sponsor’s finances, not just yours. If the person filing your Affidavit of Support has income concerns of their own, that is part of the picture too.

Breaking news today from the Board of Immigration Appeals that affects anyone who has advance parole or is planning to apply for it.

The BIA just overruled a 14-year-old decision. Leaving the United States on advance parole can now trigger the 3 or 10-year unlawful presence bar. That is a significant change from what attorneys and applicants have relied on since 2012.

The good news is the BIA said this applies going forward, not to trips that already happened. But travel from this point on has to be reassessed carefully.

If you have advance parole and you are thinking about traveling, do not leave until you have talked to an immigration attorney who has reviewed your full immigration history. Your age, how much unlawful presence you accrued, whether you have DACA, and whether a waiver is available all factor into what this means for your specific situation.
