You have a constitutional right to be free from unreasonable searches and seizures.

The Fourth Amendment protects you from unlawful government intrusion into your person, home, vehicle, and belongings. In many circumstances, law enforcement must have probable cause, a warrant, or a recognized legal exception before conducting a search or seizure.

And remember: just because an officer asks to search doesn’t always mean you have to say yes. 🚫

The Constitution gives you the right to confront and question the witnesses testifying against you.

Cross-examination is how the defense puts those accusations to the test—challenging a witness’s credibility, bias, memory, and version of events.

The government has the burden of proving its case. The Confrontation Clause gives the accused the right to challenge the evidence it uses to do it.

🚨 ONE DRINK CAN STILL LEAD TO A DUI ARREST.

Think you’re safe because you only had one drink? Think again.

A DUI arrest isn’t necessarily about how many drinks you had. It’s about whether a law enforcement officer believes you are impaired while operating a vehicle.

An officer may consider things like:
• Your driving behavior
• The smell of alcohol
• Your speech and appearance
• Your coordination
• Your performance on field sobriety exercises
• Statements you make during the traffic stop

And yes — you can be arrested even if you don’t feel drunk.

⚖️ An arrest is not a conviction. If you’ve been arrested for DUI, you have the right to challenge the evidence and the allegations against you.

One drink. One traffic stop. One decision that could have serious consequences.

One of the most important rights you have in a criminal case is this:

The government—not you—has the burden of proof.

That means the prosecution must prove every element of the crime beyond a reasonable doubt. This is an extremely high burden of proof in our legal system because your freedom is at stake.

You do not have to prove your innocence.

If there is a reasonable doubt after all the evidence is presented, the jury must return a verdict of Not Guilty.

Understanding your rights is the first step in protecting them.
