Are debt collection lawsuits and foreclosures becoming more aggressive in Florida? Here's what I'm seeing firsthand.
Over the past few weeks, I've noticed a concerning trend in my bankruptcy practice: a dramatic increase in the number of people coming to us with urgent debt collection lawsuits, wage garnishments, and pending foreclosures.
In fact, on our way to an advanced bankruptcy conference in Hawaii, we helped save a client's home from a foreclosure sale between flights. That's how time-sensitive some of these situations have become.
I'm sharing this because I want you to know three things:
1 You're not alone. More and more of the people I'm speaking with are facing lawsuits and aggressive collection efforts.
2 Please don't ignore a lawsuit. If you've been served with a debt collection lawsuit in Florida, pay attention to your deadline to respond and any scheduled court hearings. Failing to take action can result in a default judgment, which may allow creditors to pursue wage garnishments, bank account garnishments, or liens, depending on the circumstances and applicable exemptions.
3 You have options. Bankruptcy isn't the right solution for everyone, but understanding your legal rights and exploring your options BEFORE things escalate can make an enormous difference.
As a Florida bankruptcy attorney, one of the most important things I want people to understand is that you don't have to wait until you're facing a foreclosure sale or a judgment to make a plan.
And if you've already been sued? It's not necessarily too late.... bankruptcy is a very powerful financial tool that can offer tremendous relief!
At Lynn Law Group, we help individuals and families throughout Fort Myers, Cape Coral, Naples, Southwest Florida, and across the state navigate debt, lawsuits, foreclosure, and bankruptcy.
